Abychom usnadnili orientaci v t\u00e9to problematice, zva\u017ete pojmy \u201erezident\u201c a \u201enerezident\u201c. V p\u0159\u00edpad\u011b, \u017ee jste v zemi m\u00e9n\u011b ne\u017e \u0161est m\u011bs\u00edc\u016f v roce, investujete do ekonomiky st\u00e1tu a va\u0161i rodinn\u00ed p\u0159\u00edslu\u0161n\u00edci \u017eij\u00ed ve \u0160pan\u011blsku, administrativn\u00ed syst\u00e9m v\u00e1s automaticky definuje jako rezidenta. Pokud nespl\u0148ujete zadan\u00e1 krit\u00e9ria, jste nerezident. Podle \u0161pan\u011blsk\u00e9ho pr\u00e1va je ka\u017ed\u00fd z man\u017eel\u016f samostatn\u00fdm da\u0148ov\u00fdm poplatn\u00edkem a pod\u00e1v\u00e1 sv\u00e9 vlastn\u00ed da\u0148ov\u00e9 p\u0159izn\u00e1n\u00ed. Pokud maj\u00ed spole\u010dn\u00fd majetek, pak jsou v\u0161echny z\u00e1vazky rozd\u011bleny mezi oba. P\u0159\u00edru\u010dkou da\u0148ov\u00e9ho inspektora je vym\u011b\u0159ovac\u00ed tabulka, podle kter\u00e9 b\u00fdv\u00e1 hodnota nemovitosti pon\u011bkud podhodnocena. Katastr\u00e1ln\u00ed hodnota je uvedena v dokladu IBI (i u skladu nebo stodoly).<\/p>\n<h3> Nerezident, kter\u00fd kupuje nemovitost, mus\u00ed ve \u0160pan\u011blsku platit \u0161est druh\u016f dan\u00ed:<\/h3>\n<ol>\n<li> Takzvan\u00e1 <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/news\/personal-income-tax-in-spain\">da\u0148 z p\u0159\u00edjmu<\/a> pro nerezidenty EU. Plat\u00ed se bez ohledu na to, zda m\u00e1te p\u0159\u00edjem z pron\u00e1jmu nebo ne.<\/li>\n<li> <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/what-is-ibi-tax\">IBI da\u0148<\/a><\/li>\n<li> Pro likvidaci odpadu.<\/li>\n<li> Pro luxus. Distribuov\u00e1no selektivn\u011b.<\/li>\n<li> Zvl\u00e1\u0161tn\u00ed da\u0148 (dot\u00fdk\u00e1 se pouze offshore holding\u016f).<\/li>\n<\/ol>\n<p> Pod\u00edvejme se na tyto body podrobn\u011bji.<\/p>\n<h3> Da\u0148 z p\u0159\u00edjmu pro nerezidenty EU<\/h3>\n<p> V\u00fd\u0161e dan\u011b, kterou zaplat\u00edte, bude z\u00e1viset na tom, zda m\u00e1te p\u0159\u00edjem z pron\u00e1jmu. Jak se tato da\u0148 po\u010d\u00edt\u00e1? Katastr\u00e1ln\u00ed hodnotu pot\u0159ebujete vyn\u00e1sobit 2 % (1,1 %, pokud byla hodnota nemovitosti revidov\u00e1na v posledn\u00edch deseti letech), tzn. Zdan\u011bna jsou pouze 2 % (1,1 %) z hodnoty nemovitosti. Tento \u201ez\u00e1klad dan\u011b\u201c se pak vyn\u00e1sob\u00ed kvalifikovanou sazbou dan\u011b, kter\u00e1 se li\u0161\u00ed pro rezidenty EU nebo EHP a nerezidenty:<\/p>\n<ul>\n<li> obyvatel\u00e9 EU \u2013 19 %<\/li>\n<li> obyvatel\u00e9 mimo EU \u2013 24 %<\/li>\n<\/ul>\n<p> P\u0159\u00edklad: Pokud nejste rezidentem a katastr\u00e1ln\u00ed hodnota va\u0161\u00ed nemovitosti je 85 000 EUR (hodnota byla za posledn\u00edch 10 let revidov\u00e1na), pak k zaplacen\u00ed dan\u011b z p\u0159\u00edjmu z nemovitosti budete pot\u0159ebovat:<\/p>\n<p style=\"text-align: center;\"> <em><strong>85 000 \u00d7 1,1 % \u00d7 24 % = 224,40 \u20ac<\/strong><\/em><\/p>\n<p style=\"text-align: left;\"> Jsem povinen platit dan\u011b, pokud nepronaj\u00edm\u00e1m svou nemovitost Podle \u0161pan\u011blsk\u00e9ho pr\u00e1va se tento typ dan\u011b vypo\u010d\u00edt\u00e1v\u00e1 ka\u017ed\u00fd rok bez ohledu na to, zda nemovitost generuje p\u0159\u00edjem?<\/p>\n<p style=\"text-align: left;\"> Da\u0148 pro obyvatele EU a EHP:<\/p>\n<ul>\n<li style=\"text-align: left;\"> rovn\u00e1 se 19 %;<\/li>\n<li style=\"text-align: left;\"> neexistuj\u00ed \u017e\u00e1dn\u00e9 v\u00fdhody;<\/li>\n<li style=\"text-align: left;\"> vypl\u00e1cen\u00e9 jednou ro\u010dn\u011b. U nemovitost\u00ed po\u0159\u00edzen\u00fdch v polovin\u011b roku za\u010d\u00edn\u00e1 \u010dasov\u00e9 rozli\u0161en\u00ed od data nabyt\u00ed;<\/li>\n<li style=\"text-align: left;\"> da\u0148ov\u00fd formul\u00e1\u0159 210.<\/li>\n<\/ul>\n<p> Pro obyvatele mimo EU\/EHP:<\/p>\n<ul>\n<li> sazba &#8211; 24 %;<\/li>\n<li> neexistuj\u00ed \u017e\u00e1dn\u00e9 v\u00fdhody;<\/li>\n<li> jednor\u00e1zov\u00e1 ro\u010dn\u00ed platba. P\u0159i koupi domu v polovin\u011b roku za\u010d\u00edn\u00e1 \u010dasov\u00e9 rozli\u0161en\u00ed od koup\u011b;<\/li>\n<li> formul\u00e1\u0159 210<\/li>\n<\/ul>\n<p> Pokud m\u00e1te p\u0159\u00edjem z pron\u00e1jmu nemovitosti: Pro rezidenty:<\/p>\n<ul>\n<li> sazba dan\u011b &#8211; 19 %;<\/li>\n<li> existuj\u00ed v\u00fdhody. Z dan\u011b se ode\u010d\u00edt\u00e1 \u010d\u00e1stka poji\u0161t\u011bn\u00ed dom\u00e1cnosti, \u00faroky z hypot\u00e9ky apod.;<\/li>\n<li> jednou za t\u0159i m\u011bs\u00edce;<\/li>\n<li> Formul\u00e1\u0159 210.<\/li>\n<\/ul>\n<p> Pro nerezidenty:<\/p>\n<ul>\n<li> sazba 24 %;<\/li>\n<li> neexistuj\u00ed \u017e\u00e1dn\u00e9 v\u00fdhody;<\/li>\n<li> v\u00fdplata ka\u017ed\u00e9 3 m\u011bs\u00edce<\/li>\n<li> Formul\u00e1\u0159 210.<\/li>\n<\/ul>\n<h3> IBI da\u0148 z nemovitosti<\/h3>\n<p> Da\u0148 z majetku IBI je spole\u010dn\u00e1 da\u0148, kterou plat\u00ed ob\u011b skupiny vlastn\u00edk\u016f (rezidenti i nerezidenti). Vyzvednut\u00ed v kancel\u00e1\u0159i starosty v m\u00edst\u011b va\u0161eho bydli\u0161t\u011b. M\u00edstn\u00ed \u00fa\u0159ady samy reguluj\u00ed sazby &#8211; 0,4 a\u017e 1,1 % z hodnoty katastru.<\/p>\n<h3> Da\u0148 za likvidaci odpadu.<\/h3>\n<p> Plat\u00ed ji jak rezidenti, tak nerezidenti. Ka\u017ed\u00e9 m\u011bsto m\u00e1 sv\u00e9 vlastn\u00ed podm\u00ednky a \u010d\u00e1stky. Nap\u0159\u00edklad v Torrevieji se tato da\u0148 plat\u00ed dvakr\u00e1t ro\u010dn\u011b (21,36 eur).<\/p>\n<h3> Da\u0148 z luxusu.<\/h3>\n<p> Ve v\u011bt\u0161in\u011b autonomn\u00edch oblast\u00ed \u0160pan\u011blska, pokud m\u00e1te majetek v hodnot\u011b vy\u0161\u0161\u00ed ne\u017e 700 000 eur (n\u011bkter\u00e9 autonomn\u00ed oblasti maj\u00ed r\u016fzn\u00e9 \u010d\u00e1stky, nap\u0159\u00edklad ve Valencijsk\u00e9m spole\u010denstv\u00ed &#8211; 500 000 eur), jste povinni zaplatit da\u0148 vypo\u010dtenou sazbou 0,2 &#8211; 3,75 % z celkov\u00e9 hodnoty aktiv v z\u00e1vislosti na jejich v\u00fd\u0161i. Dnes se tato da\u0148 neplat\u00ed pouze v Andalusii a Madridu. Vypl\u00e1ceno ro\u010dn\u011b do 31.12. Da\u0148ov\u00fd formul\u00e1\u0159: 714<\/p>\n<h3> Zvl\u00e1\u0161tn\u00ed da\u0148 z nemovitosti (GEBI).<\/h3>\n<p> Pokud jste zakoupili nemovitost ve \u0160pan\u011blsku prost\u0159ednictv\u00edm offshore holdingov\u00e9 spole\u010dnosti, mus\u00edte ro\u010dn\u011b zaplatit 3 % z katastr\u00e1ln\u00ed hodnoty nemovitosti. Nerezident\u016fm je p\u0159\u00edle\u017eitostn\u011b vr\u00e1cena tato da\u0148, ale v takov\u00fdch p\u0159\u00edpadech by byla u\u017eite\u010dn\u00e1 pr\u00e1vn\u00ed rada. Platby se prov\u00e1d\u011bj\u00ed do 31.12. Da\u0148ov\u00fd formul\u00e1\u0159: 213.<\/p>\n<h2> Co se m\u016f\u017ee st\u00e1t nerezidentovi, pokud tyto dan\u011b ve \u0160pan\u011blsku ignoruje?<\/h2>\n<p> V d\u016fsledku toho v\u00e1m jako poru\u0161ovateli \u0161pan\u011blsk\u00fdch z\u00e1kon\u016f bude zam\u00edtnuto prodlou\u017een\u00ed <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/residence-permit-in-spain-expert-answers\">povolen\u00ed k pobytu<\/a> . Svou nemovitost pak m\u016f\u017eete prodat, darovat nebo zd\u011bdit. Je t\u0159eba m\u00edt na pam\u011bti, \u017ee za dluhy po lh\u016ft\u011b splatnosti nar\u016fstaj\u00ed sankce a obec m\u016f\u017ee dluh vym\u00e1hat n\u00e1siln\u011b, zablokovat v\u00e1m \u00fa\u010dty a dokonce v\u00e1m vz\u00edt majetek, aby splatila neplacen\u00ed.<\/p>\n<h3> Bude se po mn\u011b p\u00e1trat v zahrani\u010d\u00ed, kdy\u017e budu m\u00edt da\u0148ov\u00e9 dluhy?<\/h3>\n<p> Na tohle se moc \u010dasto nedost\u00e1v\u00e1. Ztrat\u00edte ale schopnost prov\u00e1d\u011bt transakce s nemovitostmi a budete \u017ealov\u00e1ni. Interpol se o v\u00e1s bude zaj\u00edmat pouze v p\u0159\u00edpad\u011b, \u017ee:<\/p>\n<ul>\n<li> m\u00e1te nesplacenou hypot\u00e9ku a jin\u00e9 \u00fav\u011bry;<\/li>\n<li> dlu\u017e\u00edme vlastn\u00edk\u016fm nemovitost\u00ed;<\/li>\n<li> m\u00edt velk\u00e9 dluhy v\u016f\u010di developer\u016fm;<\/li>\n<li> V dluhu z\u016fst\u00e1v\u00e1te i po zabaven\u00ed majetku.<\/li>\n<\/ul>\n<p> Jak se mohu dozv\u011bd\u011bt o sv\u00fdch dan\u00edch a dluz\u00edch, kdy\u017e jsem mimo \u0160pan\u011blsko? Prost\u0159ednictv\u00edm sv\u00e9ho opr\u00e1vn\u011bn\u00e9ho z\u00e1stupce. Bude dost\u00e1vat v\u0161echna upozorn\u011bn\u00ed. M\u016f\u017eete tak\u00e9 vyu\u017e\u00edt slu\u017eeb na\u0161\u00ed spole\u010dnosti.
