Dnes podle statistik kon\u010d\u00ed v\u00edce ne\u017e 60 % man\u017eelstv\u00ed v zemi rozvodem, co\u017e \u0159ad\u00ed \u0160pan\u011blsko na 2. m\u00edsto na sv\u011bt\u011b v po\u010dtu zru\u0161en\u00fdch man\u017eelstv\u00ed po Lucembursku. A podstatnou roli v tom hraje maxim\u00e1ln\u011b zjednodu\u0161en\u00fd postup. Rekordn\u00ed byl rok 2006, kdy bylo v zemi pod\u00e1no t\u00e9m\u011b\u0159 127 tis\u00edc rozvod\u016f. V sou\u010dasn\u00e9 dob\u011b se jejich po\u010det dr\u017e\u00ed kolem 90 tis\u00edc ro\u010dn\u011b.<\/p>\n<h2> Kdo se m\u016f\u017ee ve \u0160pan\u011blsku rozv\u00e9st?<\/h2>\n<p> O rozvod ve \u0160pan\u011blsku mohou po\u017e\u00e1dat tyto osoby:<\/p>\n<ul>\n<li> Dva \u0161pan\u011bl\u0161t\u00ed ob\u010dan\u00e9, kte\u0159\u00ed jsou \u017eenat\u00ed.<\/li>\n<li> \u0160pan\u011blsk\u00fd ob\u010dan a ciz\u00ed ob\u010dan, kte\u0159\u00ed jsou man\u017eel\u00e9.<\/li>\n<li> Dva ciz\u00ed st\u00e1tn\u00ed p\u0159\u00edslu\u0161n\u00edci, za p\u0159edpokladu, \u017ee alespo\u0148 jeden je rezidentem \u0160pan\u011blska (bez ohledu na to, kde byl s\u0148atek uzav\u0159en \u2013 ve \u0160pan\u011blsku samotn\u00e9m nebo v jak\u00e9koli jin\u00e9 zemi).<\/li>\n<\/ul>\n<p> \u010casto vyvst\u00e1v\u00e1 ot\u00e1zka, jak\u00e9 z\u00e1kony zem\u011b budou rozvod \u0159\u00eddit, pokud jeden z man\u017eel\u016f podal \u017e\u00e1dost ve \u0160pan\u011blsku a druh\u00fd ve sv\u00e9 domovsk\u00e9 zemi. V tomto p\u0159\u00edpad\u011b bude platn\u00e9 rozhodnut\u00ed soudu, kter\u00fd \u017e\u00e1dost obdr\u017eel jako prvn\u00ed.<\/p>\n<h2> Z\u00e1kladn\u00ed podm\u00ednky a po\u017eadavky pro rozvod ve \u0160pan\u011blsku<\/h2>\n<p> V sou\u010dasn\u00e9 dob\u011b nejsou man\u017eel\u00e9 povinni sv\u00e9 rozhodnut\u00ed od\u016fvod\u0148ovat ani uv\u00e1d\u011bt d\u016fvod rozvodu. \u017d\u00e1dost o rozvod lze podat za n\u00e1sleduj\u00edc\u00edch podm\u00ednek:<\/p>\n<ul>\n<li> Man\u017eel\u00e9 jsou man\u017eel\u00e9 minim\u00e1ln\u011b 3 m\u011bs\u00edce.<\/li>\n<li> \u017dadatel v dob\u011b pod\u00e1n\u00ed \u017e\u00e1dosti \u017eil ve \u0160pan\u011blsku minim\u00e1ln\u011b 6 m\u011bs\u00edc\u016f (potvrzeno registrac\u00ed).<\/li>\n<li> Alespo\u0148 jeden z man\u017eel\u016f je \u0161pan\u011blsk\u00fdm ob\u010danem nebo m\u00e1 povolen\u00ed k pobytu.<\/li>\n<\/ul>\n<p> Neexistuje po\u017eadavek, aby v dob\u011b pod\u00e1n\u00ed \u017e\u00e1dosti o rozvod \u017eily po ur\u010ditou dobu odd\u011blen\u011b, jak je vy\u017eadov\u00e1no v n\u011bkter\u00fdch jin\u00fdch zem\u00edch.<\/p>\n<h2> Druhy rozvodu ve \u0160pan\u011blsku<\/h2>\n<p> Ve \u0160pan\u011blsku existuj\u00ed dva typy rozvodu: na z\u00e1klad\u011b vz\u00e1jemn\u00e9ho souhlasu (Divorcio de com\u00fan acuerdo) a na z\u00e1klad\u011b soudn\u00edho p\u0159\u00edkazu (Divorcio contencioso). <strong>Rozvod po vz\u00e1jemn\u00e9 dohod\u011b<\/strong> je mo\u017en\u00fd v p\u0159\u00edpad\u011b \u00fapln\u00e9 shody a neexistence spor\u016f mezi man\u017eely. V tomto p\u0159\u00edpad\u011b rozvodov\u00e9 \u0159\u00edzen\u00ed prob\u00edh\u00e1 mimosoudn\u011b uzav\u0159en\u00edm odpov\u00eddaj\u00edc\u00ed dohody, naz\u00fdvan\u00e9 \u201eregula\u010dn\u00ed dohoda\u201c &#8211; convenio regulador. Tato dohoda se spolu s n\u00e1vrhem na rozvod p\u0159edkl\u00e1d\u00e1 kter\u00e9mukoli not\u00e1\u0159i nebo soudn\u00edmu \u00fa\u0159edn\u00edkovi soudn\u00edho obvodu, kde maj\u00ed man\u017eel\u00e9 bydli\u0161t\u011b. Pokud se man\u017eel\u00e9 rozhodnou formalizovat rozvod prost\u0159ednictv\u00edm not\u00e1\u0159e, mus\u00ed jmenovat alespo\u0148 jednoho pr\u00e1vn\u00edka a v tomto p\u0159\u00edpad\u011b nebude vy\u017eadov\u00e1n z\u00e1sah st\u00e1tn\u00edho z\u00e1stupce do procesu. Je tak\u00e9 nutn\u00e9 po\u010d\u00edtat s t\u00edm, \u017ee rozvod prost\u0159ednictv\u00edm not\u00e1\u0159e je mo\u017en\u00fd pouze v p\u0159\u00edpad\u011b, \u017ee v rodin\u011b nejsou nezletil\u00e9 d\u011bti. V p\u0159\u00edpad\u011b d\u011bt\u00ed bude \u00fa\u010dast st\u00e1tn\u00edho z\u00e1stupce a soudce povinn\u00e1: budou to oni, kdo bude hodnotit dosa\u017eenou regula\u010dn\u00ed dohodu z hlediska z\u00e1jm\u016f a pr\u00e1v nezletil\u00fdch. Rozvod na z\u00e1klad\u011b vz\u00e1jemn\u00e9ho souhlasu je pom\u011brn\u011b rychl\u00fd a levn\u00fd zp\u016fsob, jak rozv\u00e9st man\u017eelstv\u00ed, na rozd\u00edl od rozvodu prost\u0159ednictv\u00edm soudu. P\u0159ibli\u017en\u011b 80 % rozvod\u016f ve \u0160pan\u011blsku prob\u00edh\u00e1 po vz\u00e1jemn\u00e9 dohod\u011b. <strong>Rozvod na z\u00e1klad\u011b soudn\u00edho p\u0159\u00edkazu<\/strong> je zdlouhav\u00fd a n\u00e1kladn\u00fd proces \u2013 vynucen\u00e9 opat\u0159en\u00ed v p\u0159\u00edpad\u011b spor\u016f a rozpor\u016f mezi man\u017eely a nemo\u017enosti dos\u00e1hnout vz\u00e1jemn\u00e9 dohody. Podm\u00ednky z\u00e1niku man\u017eelstv\u00ed v tomto p\u0159\u00edpad\u011b stanov\u00ed soudce. Jeden z man\u017eel\u016f se m\u016f\u017ee obr\u00e1tit se \u017e\u00e1dost\u00ed na soud; druh\u00fd z man\u017eel\u016f bude o tom informov\u00e1n a bude m\u00edt 20 dn\u016f na p\u0159\u00edpravu odpov\u011bdi. Vzhledem k chyb\u011bj\u00edc\u00ed vz\u00e1jemn\u00e9 dohod\u011b nen\u00ed p\u0159edlo\u017eena \u017e\u00e1dn\u00e1 regula\u010dn\u00ed dohoda. Oba man\u017eel\u00e9 jmenuj\u00ed advok\u00e1ty a advok\u00e1ty, aby zastupovali a chr\u00e1nili jejich z\u00e1jmy, a jsou to pr\u00e1v\u011b pr\u00e1vn\u00edci, kte\u0159\u00ed povedou hlavn\u00ed jedn\u00e1n\u00ed a diskuse za \u00fa\u010delem dosa\u017een\u00ed dohody.<\/p>\n<h2> Rozd\u011blen\u00ed majetku p\u0159i rozvodu ve \u0160pan\u011blsku<\/h2>\n<p> P\u0159i absenci vz\u00e1jemn\u00e9 dohody rozhoduje soudce a v ka\u017ed\u00e9m konkr\u00e9tn\u00edm p\u0159\u00edpad\u011b to bude individu\u00e1ln\u00ed. P\u0159ed rozd\u011blen\u00edm majetku a st\u00e1vaj\u00edc\u00edch dluh\u016f a v\u011bcn\u00fdch b\u0159emen se zva\u017euje situace s d\u011btmi. Z\u00e1jmy d\u011bt\u00ed jsou prvn\u00ed a nejd\u016fle\u017eit\u011bj\u0161\u00ed v\u011bc\u00ed, kterou bude soudce zohled\u0148ovat. Zohledn\u00ed se m\u00edsto bydli\u0161t\u011b d\u011bt\u00ed \u2013 kde bydlely p\u0159ed a kde bydlely v dob\u011b rozvodu. A s vysokou m\u00edrou pravd\u011bpodobnosti z\u016fstanou ve stejn\u00e9m dom\u011b (bez p\u0159evodu vlastnictv\u00ed) spolu s matkou, kter\u00e1 z\u016fst\u00e1v\u00e1 v p\u00e9\u010di, i kdy\u017e majetek pat\u0159\u00ed otci. Jakmile budou vy\u0159e\u0161eny z\u00e1le\u017eitosti t\u00fdkaj\u00edc\u00ed se d\u011bt\u00ed a opatrovnictv\u00ed, je \u010das \u0159e\u0161it majetkov\u00e9 z\u00e1le\u017eitosti. V tomto p\u0159\u00edpad\u011b se zohled\u0148uje majetkov\u00fd re\u017eim man\u017eel\u016f \u2013 re\u017eim bezpod\u00edlov\u00e9ho spoluvlastnictv\u00ed majetku (r\u00e9gimen de comunidad de bienes) nebo re\u017eim odd\u011blen\u00e9ho vlastnictv\u00ed majetku (r\u00e9gimen de separaci\u00f3n de bienes):<\/p>\n<ul>\n<li> V re\u017eimu bezpod\u00edlov\u00e9ho spoluvlastnictv\u00ed se ve\u0161ker\u00fd majetek nabyt\u00fd za man\u017eelstv\u00ed rozd\u011bl\u00ed mezi man\u017eele rovn\u00fdm d\u00edlem; Majetek nabyt\u00fd p\u0159ed man\u017eelstv\u00edm nepodl\u00e9h\u00e1 d\u011blen\u00ed.<\/li>\n<li> V odd\u011blen\u00e9m majetkov\u00e9m re\u017eimu si ka\u017ed\u00fd z man\u017eel\u016f ponech\u00e1v\u00e1 majetek nabyt\u00fd b\u011bhem man\u017eelstv\u00ed na jeho jm\u00e9no.<\/li>\n<\/ul>\n<p> Pokud bylo man\u017eelstv\u00ed uzav\u0159eno v jin\u00e9 zemi, bere se v \u00favahu v\u00fdchoz\u00ed majetkov\u00fd re\u017eim nebo majetkov\u00fd re\u017eim zvolen\u00fd man\u017eely.<\/p>\n<h2> Ekonomick\u00e9 od\u0161kodn\u011bn\u00ed p\u0159i rozvodu ve \u0160pan\u011blsku<\/h2>\n<p> Slab\u0161\u00ed a ekonomicky zraniteln\u011bj\u0161\u00ed strana m\u016f\u017ee m\u00edt v p\u0159\u00edpad\u011b rozvodu a za ur\u010dit\u00fdch okolnost\u00ed n\u00e1rok na od\u0161kodn\u011bn\u00ed. Ekonomick\u00e1 situace obou man\u017eel\u016f se zohled\u0148uje jak v dob\u011b rozvodu, tak i b\u011bhem man\u017eelstv\u00ed. Pokud slab\u0161\u00ed strana v\u011bnovala hodn\u011b \u010dasu v\u00fdchov\u011b a p\u00e9\u010di o d\u011bti, vzdala se kari\u00e9ry, s nejv\u011bt\u0161\u00ed pravd\u011bpodobnost\u00ed j\u00ed bude p\u0159izn\u00e1no ekonomick\u00e9 od\u0161kodn\u011bn\u00ed. Posuzovat se bude samoz\u0159ejm\u011b cel\u00e1 \u0159ada individu\u00e1ln\u00edch okolnost\u00ed: v\u011bk obou man\u017eel\u016f, re\u00e1ln\u00e9 \u0161ance naj\u00edt si pr\u00e1ci, naj\u00edt jin\u00fd zdroj p\u0159\u00edjm\u016f nebo zv\u00fd\u0161it p\u0159\u00edjem po rozvodu. V\u00fd\u0161i a dobu od\u0161kodn\u011bn\u00ed ur\u010d\u00ed soudce ve sv\u00e9m rozhodnut\u00ed.<\/p>\n<h2> P\u00e9\u010de o d\u00edt\u011b a alimenty<\/h2>\n<p> P\u00e9\u010de o d\u011bti ve \u0160pan\u011blsku m\u016f\u017ee b\u00fdt v\u00fdhradn\u00ed nebo spole\u010dn\u00e1. Ve v\u00fdhradn\u00ed p\u00e9\u010di d\u011bti obvykle z\u016fst\u00e1vaj\u00ed s matkou a otec m\u00e1 pr\u00e1vo je nav\u0161t\u011bvovat a do\u010dasn\u011b si je vz\u00edt k sob\u011b podle stanoven\u00e9ho rozvrhu. Ve spole\u010dn\u00e9 p\u00e9\u010di jsou povinnosti a po\u017eadavky t\u00fdkaj\u00edc\u00ed se pobytu, p\u00e9\u010de a v\u00fdchovy d\u00edt\u011bte rozd\u011bleny rovn\u00fdm d\u00edlem mezi oba rodi\u010de. V p\u0159\u00edpad\u011b v\u00fdhradn\u00ed p\u00e9\u010de se plat\u00ed i m\u011bs\u00ed\u010dn\u00ed alimenty, jejich\u017e v\u00fdpo\u010det nezohled\u0148uje v\u00fd\u0161i p\u0159\u00edjmu. Soudce v\u0161ak m\u016f\u017ee na\u0159\u00eddit i dal\u0161\u00ed od\u0161kodn\u011bn\u00ed s p\u0159ihl\u00e9dnut\u00edm k p\u0159\u00edjmu a st\u00e1vaj\u00edc\u00edmu majetku (pokud strany neuzav\u0159ely jinou dohodu). P\u0159esto\u017ee je ve \u0160pan\u011blsku plnoletost 18 let, z\u00e1kon vy\u017eaduje, aby se v\u00fd\u017eivn\u00e9 vypl\u00e1celo do doby, ne\u017e se d\u00edt\u011b stane ekonomicky nez\u00e1visl\u00e9, tzn. Neexistuj\u00ed \u017e\u00e1dn\u00e9 striktn\u00ed term\u00edny. Jak\u00e1koli dohoda rozv\u00e1d\u011bj\u00edc\u00edch se man\u017eel\u016f o d\u011btsk\u00fdch pr\u00e1vech bude d\u016fkladn\u011b prov\u011b\u0159ena st\u00e1tn\u00edm z\u00e1stupcem a soudcem a pot\u00e9 bude schv\u00e1lena nebo zam\u00edtnuta.<\/p>\n<h2> Dohoda o rozvodu<\/h2>\n<p> Dobrovoln\u00e1 dohoda nebo dohoda p\u0159ipraven\u00e1 pr\u00e1vn\u00edky jako v\u00fdsledek jedn\u00e1n\u00ed za \u00fa\u010delem p\u0159edlo\u017een\u00ed soudu mus\u00ed obsahovat tyto informace:<\/p>\n<ul>\n<li> Kdo dostane d\u011bti do p\u00e9\u010de;<\/li>\n<li> N\u00e1v\u0161t\u011bvn\u00ed \u0159\u00e1d nebo zp\u016fsob bydlen\u00ed d\u00edt\u011bte (d\u011bt\u00ed);<\/li>\n<li> V\u00fdchova d\u00edt\u011bte (d\u011bt\u00ed) po rozvodu;<\/li>\n<li> Rozd\u011blen\u00ed majetku;<\/li>\n<li> V\u00fd\u017eivn\u00e9;<\/li>\n<li> Hlavn\u00ed bydli\u0161t\u011b rodiny a bydlen\u00ed v n\u00ed;<\/li>\n<li> Ekonomick\u00e1 kompenzace.<\/li>\n<\/ul>\n<p> Dohoda je p\u0159edlo\u017eena soudu, kde soudce jej\u00ed ustanoven\u00ed vyhodnot\u00ed a v p\u0159\u00edpad\u011b pot\u0159eby provede zm\u011bny. Po soudn\u00edm p\u0159ezkoum\u00e1n\u00ed je dohoda zaps\u00e1na do ob\u010dansk\u00e9ho rejst\u0159\u00edku, pot\u00e9 se proti n\u00ed m\u016f\u017ee odvolat disentuj\u00edc\u00ed strana.<\/p>\n<h2> Dokumenty pot\u0159ebn\u00e9 pro rozvod ve \u0160pan\u011blsku<\/h2>\n<p> Krom\u011b p\u0159ihl\u00e1\u0161ky a dohody se p\u0159edkl\u00e1daj\u00ed n\u00e1sleduj\u00edc\u00ed dokumenty:<\/p>\n<ul>\n<li> Oddac\u00ed list;<\/li>\n<li> Rodn\u00e9 listy d\u011bt\u00ed;<\/li>\n<li> Da\u0148ov\u00e1 p\u0159izn\u00e1n\u00ed za posledn\u00ed 3 roky a mzdov\u00e9 v\u00fdkazy;<\/li>\n<li> Seznam majetku, movit\u00e9ho i nemovit\u00e9ho, v\u011bcn\u00fdch b\u0159emen, dluh\u016f ka\u017ed\u00e9ho z man\u017eel\u016f, d\u00e1le kalkulace v\u00fddaj\u016f na d\u00edt\u011b za rok, v\u010detn\u011b listin a jin\u00fdch listin o vlastnictv\u00ed, bankovn\u00ed certifik\u00e1ty, potvrzen\u00ed o nesplacen\u00e9m dluhu na spot\u0159ebitelsk\u00fdch \u00fav\u011brech, hypote\u010dn\u00edch \u00fav\u011brech atd.<\/li>\n<\/ul>\n<p> V\u0161echny dokumenty vydan\u00e9 v ciz\u00edm jazyce mus\u00ed b\u00fdt opat\u0159eny apostilou a p\u0159elo\u017eeny soudn\u00edm p\u0159ekladatelem do \u0161pan\u011bl\u0161tiny.<\/p>\n<h2> Jak dlouho trv\u00e1 rozvod a kolik stoj\u00ed ve \u0160pan\u011blsku?<\/h2>\n<p> Rozvod po vz\u00e1jemn\u00e9 dohod\u011b man\u017eel\u016f bez d\u011bt\u00ed trv\u00e1 v pr\u016fm\u011bru 4 a\u017e 6 t\u00fddn\u016f. Pokud existuj\u00ed d\u011bti, ale man\u017eel\u00e9 se vz\u00e1jemn\u011b dohodli a vypracovali regula\u010dn\u00ed dohodu, kter\u00e1 zcela vyhovuje st\u00e1tn\u00edmu z\u00e1stupci, m\u016f\u017eete po\u010d\u00edtat se 4\u20136 m\u011bs\u00edci. V p\u0159\u00edpad\u011b spor\u016f a konflikt\u016f mezi man\u017eely se rozvod m\u016f\u017ee prot\u00e1hnout rok i d\u00e9le. N\u00e1klady na rozvod je velmi obt\u00ed\u017en\u00e9 ur\u010dit, zvl\u00e1\u0161t\u011b pokud je proces zdlouhav\u00fd a nekone\u010dn\u00e9 spory.
