K pln\u00e9 moci mus\u00ed b\u00fdt p\u0159ilo\u017eeny kopie ob\u010dansk\u00fdch pr\u016fkaz\u016f nebo pas\u016f, jako\u017e i NIE v\u0161ech zmocnitel\u016f. Je-li kupuj\u00edc\u00edm pr\u00e1vnick\u00e1 osoba, bude nutn\u00e9 uv\u00e9st, v jak\u00e9 funkci jedn\u00e1 jednotliv\u00fd z\u00e1stupce: opr\u00e1vn\u011bn\u00e1 osoba, jedin\u00fd jednatel, solid\u00e1rn\u00ed jednatel, jednatel atd. V\u00fdpis je ve\u0159ejnou listinou a m\u016f\u017ee si o n\u011bj vy\u017e\u00e1dat naprosto kdokoli bez souhlasu vlastn\u00edka.<\/li>\n<li> <strong>V\u00fdpis z katastru nemovitost\u00ed uv\u00e1d\u011bj\u00edc\u00ed odhadovanou tr\u017en\u00ed hodnotu nemovitosti Valor de Referencia:<\/strong> z\u00edskan\u00e9 informace umo\u017en\u00ed p\u0159edem vypo\u010d\u00edtat dan\u011b, kter\u00e9 mus\u00ed kupuj\u00edc\u00ed zaplatit. Odhadovan\u00e1 tr\u017en\u00ed hodnota, ulo\u017een\u00e1 v katastru a podl\u00e9haj\u00edc\u00ed pravideln\u00e9 revizi, se nemus\u00ed shodovat se skute\u010dnou cenou koup\u011b a prodeje (zpravidla je vy\u0161\u0161\u00ed), ale pr\u00e1v\u011b z n\u00ed se po\u010d\u00edt\u00e1 \u0159ada dan\u00ed.<\/li>\n<li> <strong>Potvrzen\u00ed o zaplacen\u00ed ro\u010dn\u00ed dan\u011b z nemovitosti \u2013 <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/what-is-ibi-tax\">Impuesto sobre Bienes Inmuebles (IBI)<\/a> .<\/strong> Prod\u00e1vaj\u00edc\u00ed je povinen dolo\u017eit posledn\u00ed potvrzen\u00ed o zaplacen\u00ed t\u00e9to dan\u011b (not\u00e1\u0159 jej bude vy\u017eadovat i pozd\u011bji). Krom\u011b toho m\u016f\u017ee kupn\u00ed smlouva stanovit pom\u011brn\u00e9 rozd\u011blen\u00ed dan\u011b b\u011b\u017en\u00e9ho roku mezi prod\u00e1vaj\u00edc\u00edho a kupuj\u00edc\u00edho, co\u017e je spravedliv\u00e9 \u0159e\u0161en\u00ed pro ob\u011b strany.<\/li>\n<li> <strong>Z\u00e1pis ze sch\u016fze vlastn\u00edk\u016f:<\/strong> pokud je nemovitost sou\u010d\u00e1st\u00ed obytn\u00e9ho souboru\/urbanizace, tzn. Not\u00e1\u0159 osv\u011bd\u010duj\u00edc\u00ed transakci je rovn\u011b\u017e povinen ov\u011b\u0159it, zda neexistuje dluh. Pokud po dokon\u010den\u00ed transakce vzniknou n\u011bjak\u00e9 dluhy, bude za n\u011b kupuj\u00edc\u00ed ru\u010dit za \u010d\u00e1st roku, ve kter\u00e9m byla nemovitost zakoupena, a za t\u0159i p\u0159edchoz\u00ed roky.<\/li>\n<li> <strong>Charta kondominia (Estatutos de la Comunidad de Propietarios)<\/strong> je kl\u00ed\u010dov\u00fdm dokumentem, kter\u00fd upravuje pravidla a p\u0159edpisy, kter\u00fdmi se mus\u00ed \u0159\u00eddit v\u0161ichni obyvatel\u00e9. N\u011bkter\u00e9 banky nab\u00edzej\u00ed zv\u00fdhodn\u011bn\u00e9 podm\u00ednky hypot\u00e9ky na nemovitosti s vysokou t\u0159\u00eddou energetick\u00e9 \u00fa\u010dinnosti.<\/li>\n<\/ol>\n<p> Ve f\u00e1zi p\u0159edb\u011b\u017en\u00e9 prohl\u00eddky by bylo dobr\u00e9 se ujistit, \u017ee v nemovitosti nejsou \u017e\u00e1dn\u00ed obyvatel\u00e9 a tak\u00e9 p\u0159\u00edtomnost \u010di nep\u0159\u00edtomnost n\u00e1jemn\u00edk\u016f. Zm\u011bna vlastnictv\u00ed nemovitosti ve \u0160pan\u011blsku automaticky neznamen\u00e1, \u017ee n\u00e1jemce mus\u00ed nemovitost opustit, zejm\u00e9na pokud spln\u00ed v\u0161echny smluvn\u00ed povinnosti t\u00fdkaj\u00edc\u00ed se n\u00e1jemn\u00e9ho. Nen\u00ed-li ve smlouv\u011b uvedeno jinak, je pronaj\u00edmatel-prod\u00e1vaj\u00edc\u00ed povinen ozn\u00e1mit n\u00e1jemc\u016fm prodej a z\u00edskat od nich p\u00edsemn\u00e9 z\u0159eknut\u00ed se jejich p\u0159edkupn\u00edho pr\u00e1va. Situace m\u016f\u017ee b\u00fdt mnohem slo\u017eit\u011bj\u0161\u00ed, pokud nemovitost okupuj\u00ed vet\u0159elci nebo n\u00e1jemn\u00edci, kte\u0159\u00ed neplat\u00ed. Soudn\u00ed \u0159\u00edzen\u00ed o jejich vyst\u011bhov\u00e1n\u00ed m\u016f\u017ee b\u00fdt zdlouhav\u00e9 a komplikovan\u00e9, tak\u017ee mnoho potenci\u00e1ln\u00edch kupc\u016f od obchodu odstoup\u00ed i ve f\u00e1zi anal\u00fdzy situace. V ide\u00e1ln\u00edm p\u0159\u00edpad\u011b by nemovitost m\u011bla b\u00fdt v dob\u011b transakce bez n\u00e1jemc\u016f a u\u017eivatel\u016f, co\u017e je obvykle zaznamen\u00e1no v kupn\u00ed a prodejn\u00ed smlouv\u011b.<\/p>\n<h2> F\u00c1ZE 3. Vypracov\u00e1n\u00ed a podpis soukrom\u00fdch smluv<\/h2>\n<p> P\u0159ed podpisem not\u00e1\u0159sk\u00e9ho z\u00e1pisu o prodeji obvykle prod\u00e1vaj\u00edc\u00ed a kupuj\u00edc\u00ed podep\u00ed\u0161\u00ed jednu nebo v\u00edce soukrom\u00fdch smluv. V t\u00e9to v\u011bci neexistuj\u00ed \u017e\u00e1dn\u00e1 jasn\u00e1 pravidla a po\u017eadavky: v\u00fdb\u011br smluv je ur\u010den dohodou stran. Nejb\u011b\u017en\u011bj\u0161\u00ed soukrom\u00e9 smlouvy, kter\u00e9 p\u0159edch\u00e1zej\u00ed not\u00e1\u0159sk\u00e9mu ov\u011b\u0159en\u00ed transakce, jsou: rezerva\u010dn\u00ed smlouva, <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/all-about-deposit-agreement-in-spain-contrato-de-arras\">smlouva o slo\u017een\u00ed z\u00e1lohy<\/a> , smlouva o kupn\u00edm pr\u00e1vu a soukrom\u00e1 kupn\u00ed a prodejn\u00ed smlouva.<\/p>\n<h3> Rezerva\u010dn\u00ed smlouva (Contrato de reserva)<\/h3>\n<p> \u010casto po prohl\u00eddce nemovitosti, i kdy\u017e se kupuj\u00edc\u00edmu l\u00edb\u00ed, pot\u0159ebuje \u010das na rozhodnut\u00ed, prostudov\u00e1n\u00ed podklad\u016f a p\u0159\u00edpadn\u011b jedn\u00e1n\u00ed s prod\u00e1vaj\u00edc\u00edm o cen\u011b. V takov\u00fdch p\u0159\u00edpadech m\u016f\u017ee prod\u00e1vaj\u00edc\u00ed nebo realitn\u00ed kancel\u00e1\u0159 nab\u00eddnout kupuj\u00edc\u00edmu podpis rezerva\u010dn\u00ed smlouvy na do\u010dasn\u00e9 vy\u0159azen\u00ed nemovitosti z prodeje. Obsah takov\u00e9 smlouvy se m\u016f\u017ee v ka\u017ed\u00e9m konkr\u00e9tn\u00edm p\u0159\u00edpad\u011b v\u00fdrazn\u011b li\u0161it, ale jej\u00edm hlavn\u00edm \u00fa\u010delem je potvrdit z\u00e1jem kupuj\u00edc\u00edho o nemovitost a zarezervovat si ji do ur\u010dit\u00e9ho data, kdy dojde k podpisu odpov\u00eddaj\u00edc\u00ed smlouvy o vkladu nebo samotn\u00e9 kupn\u00ed a prodejn\u00ed smlouvy. Rezerva\u010dn\u00ed smlouvu (stejn\u011b jako v\u0161echny ostatn\u00ed smlouvy) se doporu\u010duje sepsat pr\u00e1vn\u00edkem, proto\u017ee tato smlouva m\u016f\u017ee b\u00fdt v praxi uzn\u00e1na jako p\u0159edb\u011b\u017en\u00e1 dohoda nebo dokonce smlouva o z\u00e1lohu s ekonomick\u00fdmi d\u016fsledky pro ob\u011b strany.<\/p>\n<h3> Smlouva o v\u00fdd\u011blc\u00edch (Contrato de arras)<\/h3>\n<p> V\u00e1\u017en\u00e1 pen\u011b\u017en\u00ed smlouva, zn\u00e1m\u00e1 ve \u0160pan\u011blsku jako &quot;Contrato de Arras&quot;, je velmi d\u016fle\u017eit\u00e1, proto\u017ee slou\u017e\u00ed jako ofici\u00e1ln\u00ed potvrzen\u00ed dohody mezi kupuj\u00edc\u00edm a prod\u00e1vaj\u00edc\u00edm o v\u0161ech kl\u00ed\u010dov\u00fdch ot\u00e1zk\u00e1ch transakce. Podpisem tohoto dokumentu strany stvrzuj\u00ed svou p\u0159ipravenost p\u0159istoupit k seps\u00e1n\u00ed not\u00e1\u0159sk\u00e9ho z\u00e1pisu o prodeji. P\u0159i podpisu smlouvy o slo\u017een\u00ed z\u00e1lohy zaplat\u00ed kupuj\u00edc\u00ed \u010d\u00e1stku 5 a\u017e 15 % z ceny transakce. Tato \u010d\u00e1stka je pevn\u011b stanovena ve smlouv\u011b a n\u00e1sledn\u011b je zohledn\u011bna p\u0159i kone\u010dn\u00e9m v\u00fdpo\u010dtu v okam\u017eiku registrace transakce u not\u00e1\u0159e. Smlouva o depozitu tedy nejen zaji\u0161\u0165uje dohody uzav\u0159en\u00e9 mezi stranami, ale poskytuje tak\u00e9 finan\u010dn\u00ed z\u00e1ruku na jejich realizaci, d\u00edky \u010demu\u017e je proces n\u00e1kupu nemovitosti ve \u0160pan\u011blsku pro ob\u011b strany p\u0159edv\u00eddateln\u011bj\u0161\u00ed a bezpe\u010dn\u011bj\u0161\u00ed. Podm\u00ednky smlouvy o vkladu za prv\u00e9 nesm\u00ed odporovat norm\u00e1m platn\u00e9 legislativy; za druh\u00e9 jsou z\u00e1vazn\u00e9 pro ob\u011b strany. Po podeps\u00e1n\u00ed smlouvy o depozitu je nemovitost na ur\u010ditou dobu rezervov\u00e1na pro kupuj\u00edc\u00edho, b\u011bhem kter\u00e9 se p\u0159ipravuje obchod (sb\u00edr\u00e1 se bal\u00edk dokument\u016f pro not\u00e1\u0159e, \u0159e\u0161\u00ed se finan\u010dn\u00ed z\u00e1le\u017eitosti (p\u0159evod pen\u011bz na \u0161pan\u011blsk\u00fd \u00fa\u010det, schv\u00e1len\u00ed hypote\u010dn\u00edho \u00fav\u011bru atd.)). Ve \u0160pan\u011blsku existuje n\u011bkolik typ\u016f seri\u00f3zn\u00edch pen\u011b\u017en\u00edch dohod; Nejb\u011b\u017en\u011bj\u0161\u00ed je <strong>Contrato de arras penitenciales.<\/strong> M\u016f\u017ee b\u00fdt kdykoli ukon\u010dena kteroukoli stranou a podm\u00ednky ukon\u010den\u00ed mus\u00ed b\u00fdt jasn\u011b uvedeny v samotn\u00e9 smlouv\u011b nebo upraveny z\u00e1konem. V p\u0159\u00edpad\u011b odm\u00edtnut\u00ed transakce se d\u016fsledky pro strany mohou li\u0161it. Pokud kupuj\u00edc\u00ed zah\u00e1j\u00ed v\u00fdpov\u011b\u010f bez v\u00e1\u017en\u00e9ho d\u016fvodu, p\u0159ijde o d\u0159\u00edve zaplacenou z\u00e1lohu jako n\u00e1hradu za poru\u0161en\u00ed smlouvy. Zvl\u00e1\u0161tn\u00ed p\u0159\u00edpad je stanoven pro situace, kdy se odm\u00edtnut\u00ed poskytnut\u00ed hypote\u010dn\u00edho \u00fav\u011bru stane d\u016fvodem ne\u00fasp\u011bchu obchodu &#8211; tuto podm\u00ednku lze p\u0159edem specifikovat a prod\u00e1vaj\u00edc\u00edho zavazuje vr\u00e1tit bez n\u00e1hrady pouze v\u00fd\u0161i z\u00e1lohy.<\/p>\n<h3> Kupn\u00ed smlouva (Contrato de opci\u00f3n de compra)<\/h3>\n<p> Smlouva o pr\u00e1vu koup\u011b je p\u0159edb\u011b\u017en\u00e1 dohoda, ve kter\u00e9 prod\u00e1vaj\u00edc\u00ed ud\u011bluje kupuj\u00edc\u00edmu v\u00fdhradn\u00ed pr\u00e1vo rozhodnout, zda p\u0159istoup\u00ed k fin\u00e1ln\u00ed transakci ve stanoven\u00e9 dob\u011b a za stanoven\u00fdch podm\u00ednek. Zpravidla se tak formalizuje n\u00e1jemn\u00ed smlouva s pr\u00e1vem koup\u011b. Doba trv\u00e1n\u00ed takov\u00e9 smlouvy se m\u016f\u017ee pohybovat od n\u011bkolika m\u011bs\u00edc\u016f a\u017e po n\u011bkolik let, v p\u0159\u00edpad\u011b pron\u00e1jmu lze p\u0159i kone\u010dn\u00e9m vy\u00fa\u010dtov\u00e1n\u00ed zohlednit cel\u00e9 n\u00e1jemn\u00e9. D\u016fle\u017eit\u00fdm bodem je povinn\u00e9 p\u00edsemn\u00e9 ozn\u00e1men\u00ed prod\u00e1vaj\u00edc\u00edho ze strany kupuj\u00edc\u00edho o \u00famyslu uplatnit pr\u00e1vo koup\u011b p\u0159ed uplynut\u00edm doby platnosti smlouvy. Doporu\u010duje se formalizovat tuto smlouvu v not\u00e1\u0159sk\u00e9 form\u011b a zaregistrovat ji v katastru nemovitost\u00ed: t\u00edm je zaji\u0161t\u011bno p\u0159ednostn\u00ed pr\u00e1vo kupuj\u00edc\u00edho a poskytnuta ochrana p\u0159ed n\u00e1roky t\u0159et\u00edch osob, kter\u00e9 maj\u00ed rovn\u011b\u017e z\u00e1jem o nabyt\u00ed nemovitosti.<\/p>\n<h3> Soukrom\u00e1 kupn\u00ed smlouva (Contrato de compraventa privado)<\/h3>\n<p> Toto je dal\u0161\u00ed zprost\u0159edkovatelsk\u00e1 dohoda, kter\u00e1 se podepisuje p\u0159edt\u00edm, ne\u017e je transakce not\u00e1\u0159sky ov\u011b\u0159ena. V okam\u017eiku podpisu mus\u00ed b\u00fdt pln\u011b dokon\u010dena prohl\u00eddka objektu a dokument\u016f. Smlouva obsahuje \u00fapln\u00fd popis p\u0159edm\u011btu, podm\u00ednek, pr\u00e1v a povinnost\u00ed smluvn\u00edch stran. \u010casto p\u0159i podpisu smlouvy plat\u00ed kupuj\u00edc\u00ed dal\u0161\u00ed z\u00e1lohu prod\u00e1vaj\u00edc\u00edmu.<\/p>\n<h2> 4. ETAPA: Registrace not\u00e1\u0159sk\u00e9ho z\u00e1pisu o prodeji a koupi<\/h2>\n<p> Not\u00e1\u0159sk\u00e1 registrace smlouvy o prodeji je f\u00e1z\u00ed, kdy je transakce n\u00e1kupu a prodeje ofici\u00e1ln\u011b formalizov\u00e1na. Podepisov\u00e1n\u00ed prob\u00edh\u00e1 v kancel\u00e1\u0159i not\u00e1\u0159e zvolen\u00e9ho stranami, nej\u010dast\u011bji tuto volbu prov\u00e1d\u00ed kupuj\u00edc\u00ed. V okam\u017eiku podpisu mus\u00ed b\u00fdt vy\u0159\u00edzeny v\u0161echny z\u00e1le\u017eitosti souvisej\u00edc\u00ed s dokumentac\u00ed nemovitosti, jej\u00edmi v\u011bcn\u00fdmi b\u0159emeny, platebn\u00edmi podm\u00ednkami a dal\u0161\u00edmi aspekty. Not\u00e1\u0159 ozn\u00e1m\u00ed obsah \u00fakonu nebo jeho podstatn\u00e9 \u010d\u00e1sti, na\u010de\u017e strany vyj\u00e1d\u0159\u00ed sv\u016fj souhlas podpisem listiny. Pokud jedna ze stran nemluv\u00ed \u0161pan\u011blsky, bude vy\u017eadov\u00e1na pomoc tlumo\u010dn\u00edka. Nemus\u00ed to b\u00fdt nutn\u011b certifikovan\u00fd nebo ofici\u00e1ln\u00ed p\u0159ekladatel: pomoci m\u016f\u017ee ka\u017ed\u00fd, kdo mluv\u00ed \u0161pan\u011blsky. P\u0159ekladatel na vlastn\u00ed odpov\u011bdnost potvrd\u00ed shodu origin\u00e1lu a j\u00edm vyhotoven\u00e9ho p\u0159ekladu a spole\u010dn\u011b s prod\u00e1vaj\u00edc\u00edm, kupuj\u00edc\u00edm a not\u00e1\u0159em podep\u00ed\u0161e not\u00e1\u0159sk\u00fd z\u00e1pis. P\u0159i prodeji nemovitosti je prod\u00e1vaj\u00edc\u00ed povinen zaplatit da\u0148 ze zisku z\u00edskan\u00e9ho z transakce. V p\u0159\u00edpad\u011b, \u017ee prod\u00e1vaj\u00edc\u00ed nen\u00ed rezidentem \u0160pan\u011blska, je kupuj\u00edc\u00ed v r\u00e1mci da\u0148ov\u00e9ho ochrann\u00e9ho opat\u0159en\u00ed povinen zadr\u017eet 3 % z \u010d\u00e1stky transakce a tuto sr\u00e1\u017eku p\u0159ev\u00e9st finan\u010dn\u00edm \u00fa\u0159ad\u016fm do jednoho m\u011bs\u00edce od podpisu smlouvy o prodeji na zaveden\u00e9m formul\u00e1\u0159i 211 (doporu\u010dujeme vyhledat pomoc da\u0148ov\u00e9ho poradce). Tato \u010d\u00e1stka mus\u00ed b\u00fdt uvedena v kupn\u00ed smlouv\u011b. Pot\u00e9 bude muset prod\u00e1vaj\u00edc\u00ed s\u00e1m prov\u00e9st kone\u010dnou platbu dan\u011b p\u0159edlo\u017een\u00edm formul\u00e1\u0159e 210 finan\u010dn\u00edm \u00fa\u0159ad\u016fm St\u00e1tn\u00ed da\u0148ov\u00e1 slu\u017eba bu\u010f vr\u00e1t\u00ed p\u0159eplatek, kter\u00fd byl d\u0159\u00edve sra\u017een a zaplacen, nebo bude \u00fa\u010dtovat dodate\u010dnou da\u0148.
