Tento status mu m\u016f\u017ee b\u00fdt p\u0159izn\u00e1n i v p\u0159\u00edpad\u011b, \u017ee v zemi pob\u00fdval krat\u0161\u00ed dobu ne\u017e uvedenou dobu, ale jeho hlavn\u00ed ekonomick\u00fd nebo profesn\u00ed z\u00e1jem nebo centrum jeho \u017eivotn\u00edch z\u00e1jm\u016f je ve \u0160pan\u011blsku. Dr\u017eitel\u00e9 v\u00edz Digital Nomad mus\u00ed b\u00fdt v zemi alespo\u0148 183 dn\u00ed v roce, aby si mohli prodlou\u017eit sv\u016fj pobyt, co\u017e je automaticky \u010din\u00ed da\u0148ov\u00fdmi rezidenty. To s sebou nese ur\u010dit\u00e9 da\u0148ov\u00e9 povinnosti, kter\u00e9, jak uvid\u00edme d\u00e1le, jsou zm\u00edrn\u011bny zvl\u00e1\u0161tn\u00edmi podm\u00ednkami nov\u00e9ho v\u00edzov\u00e9ho re\u017eimu. To je d\u016fle\u017eit\u00e9 zejm\u00e9na pro digit\u00e1ln\u00ed nom\u00e1dy, jejich\u017e klienti a zam\u011bstnavatel\u00e9 se mohou nach\u00e1zet v r\u016fzn\u00fdch zem\u00edch. IRPF ve \u0160pan\u011blsku m\u00e1 progresivn\u00ed sazbu a z\u00e1vis\u00ed na v\u00fd\u0161i p\u0159\u00edjmu; Maxim\u00e1ln\u00ed sazba m\u016f\u017ee v jednotliv\u00fdch autonomn\u00edch oblastech p\u0159es\u00e1hnout 50 %. D\u00edky statusu digit\u00e1ln\u00edho nom\u00e1da ve \u0160pan\u011blsku se v\u0161ak n\u011bkte\u0159\u00ed da\u0148ov\u00ed rezidenti t\u011b\u0161\u00ed zna\u010dn\u00e9 v\u00fdhod\u011b: jejich p\u0159\u00edjem je zdan\u011bn pau\u0161\u00e1ln\u00ed sazbou, kter\u00e1 je v\u00fdrazn\u011b ni\u017e\u0161\u00ed ne\u017e standardn\u00ed sazba. Jedn\u00e1 se o jednu z kl\u00ed\u010dov\u00fdch da\u0148ov\u00fdch v\u00fdhod poskytovan\u00fdch v r\u00e1mci v\u00edza Digital Nomad.<\/p>\n<h2> Zvl\u00e1\u0161tn\u00ed da\u0148ov\u00fd re\u017eim pro digit\u00e1ln\u00ed nom\u00e1dy ve \u0160pan\u011blsku<\/h2>\n<p> Ned\u00e1vno p\u0159edstaven\u00fd <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/news\/spain-has-adopted-visa-law-for-digital-nomads\">z\u00e1kon o startupech<\/a> umo\u017e\u0148uje zvl\u00e1\u0161tn\u00ed da\u0148ov\u00fd re\u017eim pro vzd\u00e1len\u00e9 pracovn\u00edky. Krom\u011b toho je v r\u00e1mci tohoto zvl\u00e1\u0161tn\u00edho re\u017eimu zahrani\u010dn\u00ed profesion\u00e1l osvobozen od povinnosti pod\u00e1vat prohl\u00e1\u0161en\u00ed na formul\u00e1\u0159i 720 o zahrani\u010dn\u00edm majetku. Jakmile je v\u00edzum digit\u00e1ln\u00edho nom\u00e1da schv\u00e1leno, lze uplatnit <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/beckhams-law-in-spain\">\u201eBeckham\u016fv z\u00e1kon\u201c<\/a> , kter\u00fd umo\u017e\u0148uje digit\u00e1ln\u00edmu nom\u00e1dovi, kter\u00fd je zam\u011bstnancem zahrani\u010dn\u00ed spole\u010dnosti, z\u016fstat mimo status da\u0148ov\u00e9 rezidence ve \u0160pan\u011blsku. Aby bylo mo\u017en\u00e9 vyu\u017e\u00edt zvl\u00e1\u0161tn\u00edho da\u0148ov\u00e9ho re\u017eimu, mus\u00ed b\u00fdt spln\u011bn n\u00e1sleduj\u00edc\u00ed po\u017eadavek: digit\u00e1ln\u00ed nom\u00e1d nesm\u00ed b\u00fdt v minulosti rezidentem \u0160pan\u011blska, konkr\u00e9tn\u011b v posledn\u00edch 5 letech. \u201eBeckham\u016fv z\u00e1kon\u201c (zvl\u00e1\u0161tn\u00ed da\u0148ov\u00fd re\u017eim) se vztahuje pouze na zam\u011bstnance, nikoli v\u0161ak na osoby na voln\u00e9 noze. Digit\u00e1ln\u00ed nom\u00e1di, kte\u0159\u00ed nespl\u0148uj\u00ed podm\u00ednky a po\u017eadavky \u201eBeckhamova z\u00e1kona\u201c, jsou pova\u017eov\u00e1ni za da\u0148ov\u00e9 rezidenty \u0160pan\u011blska s d\u016fsledky v podob\u011b placen\u00ed dan\u011b IRPF, dan\u011b z majetku a povinnosti podat formul\u00e1\u0159 720.<\/p>\n<h2> Da\u0148ov\u00e9 sazby<\/h2>\n<p> Jako nerezidenti pro \u0161pan\u011blsk\u00e9 da\u0148ov\u00e9 \u00fa\u010dely podl\u00e9haj\u00ed dr\u017eitel\u00e9 v\u00edz Digital Nomad pau\u0161\u00e1ln\u00ed sazb\u011b 24% nerezidentsk\u00e9 dan\u011b z p\u0159\u00edjmu pouze z p\u0159\u00edjmu z\u00edskan\u00e9ho ve \u0160pan\u011blsku. Sazba 47 % se uplatn\u00ed pouze v p\u0159\u00edpad\u011b, \u017ee p\u0159\u00edjem p\u0159es\u00e1hne 600 000 EUR. Da\u0148 z p\u0159\u00edjm\u016f z\u00edskan\u00fdch nikoli z pracovn\u00ed \u010dinnosti, ale z transakc\u00ed s majetkem a pr\u00e1vy (nap\u0159\u00edklad z prodeje akci\u00ed, nemovitost\u00ed, pod\u00edl\u016f na z\u00e1kladn\u00edm kapit\u00e1lu spole\u010dnosti atd.) se ve \u0160pan\u011blsku po\u010d\u00edt\u00e1 odli\u0161n\u011b. V tomto p\u0159\u00edpad\u011b plat\u00ed n\u00e1sleduj\u00edc\u00ed sazby:<\/p>\n<ul>\n<li> 19 % pro p\u0159\u00edjem do 6 000 EUR,<\/li>\n<li> 21 % pro p\u0159\u00edjem od 6 001 EUR do 50 000 EUR,<\/li>\n<li> 23 % pro p\u0159\u00edjem od 50 001 EUR do 200 000 EUR,<\/li>\n<li> 27 % pro p\u0159\u00edjem od 200 001 EUR do 300 000 EUR,<\/li>\n<li> 28 % p\u0159i p\u0159\u00edjmu nad 300 001 EUR.<\/li>\n<\/ul>\n<p> V\u0161echny ostatn\u00ed p\u0159\u00edjmy, kter\u00e9 digit\u00e1ln\u00ed nom\u00e1d z\u00edsk\u00e1 kdekoli mimo \u0160pan\u011blsko, podl\u00e9haj\u00ed zdan\u011bn\u00ed v zemi jeho da\u0148ov\u00e9 rezidence. Aby se digit\u00e1ln\u00ed nom\u00e1d kvalifikoval pro zvl\u00e1\u0161tn\u00ed da\u0148ov\u00fd re\u017eim, mus\u00ed po obdr\u017een\u00ed v\u00edza a p\u0159\u00edletu do \u0160pan\u011blska p\u0159edlo\u017eit finan\u010dn\u00edm \u00fa\u0159ad\u016fm formul\u00e1\u0159 149. Pokud finan\u010dn\u00ed \u00fa\u0159ad \u017e\u00e1dost schv\u00e1l\u00ed, bude preferen\u010dn\u00ed da\u0148ov\u00fd re\u017eim platit 1 rok s mo\u017enost\u00ed prodlou\u017een\u00ed a\u017e na 5 let. Nepod\u00e1n\u00ed \u017e\u00e1dosti nebo zam\u00edtnut\u00ed ze strany da\u0148ov\u00e9 slu\u017eby bude znamenat, \u017ee ke zdan\u011bn\u00ed p\u0159\u00edjm\u016f digit\u00e1ln\u00edho nom\u00e1da dojde v obecn\u00e9m re\u017eimu, kter\u00fd je stejn\u00fd pro v\u011bt\u0161inu da\u0148ov\u00fdch rezident\u016f zem\u011b.<\/p>\n<h2> \u0158editel\u00e9 a mana\u017ee\u0159i spole\u010dnost\u00ed<\/h2>\n<p> Digit\u00e1ln\u00ed nom\u00e1di, kte\u0159\u00ed pracuj\u00ed na d\u00e1lku jako b\u011b\u017en\u00ed zam\u011bstnanci zahrani\u010dn\u00edch spole\u010dnost\u00ed, se ve \u0160pan\u011blsku obvykle nepot\u00fdkaj\u00ed s da\u0148ov\u00fdmi probl\u00e9my. Situace se v\u0161ak zkomplikuje, pokud je digit\u00e1ln\u00edm nom\u00e1dem jednatel nebo \u0159editel spole\u010dnosti. V takov\u00fdch p\u0159\u00edpadech mohou \u0161pan\u011blsk\u00e9 da\u0148ov\u00e9 \u00fa\u0159ady pova\u017eovat jeho \u010dinnost za vytvo\u0159en\u00ed pobo\u010dky s fyzickou kancel\u00e1\u0159\u00ed ve \u0160pan\u011blsku. Probl\u00e9m je v tom, \u017ee m\u00edt pobo\u010dku nebo zastoupen\u00ed ve \u0160pan\u011blsku znamen\u00e1 nutnost platit dan\u011b podle stejn\u00fdch pravidel a p\u0159edpis\u016f jako kter\u00e1koli jin\u00e1 m\u00edstn\u00ed spole\u010dnost. Pro z\u00edsk\u00e1n\u00ed v\u00edza digit\u00e1ln\u00edho nom\u00e1da je jednou z kl\u00ed\u010dov\u00fdch podm\u00ednek prok\u00e1z\u00e1n\u00ed, \u017ee \u017eadatel vykon\u00e1v\u00e1 odbornou \u010dinnost na d\u00e1lku pro spole\u010dnosti se s\u00eddlem mimo \u0160pan\u011blsko. Tato podm\u00ednka znamen\u00e1, \u017ee hlavn\u00ed hospod\u00e1\u0159sk\u00e1 \u010dinnost nesm\u00ed b\u00fdt p\u0159evedena do \u0160pan\u011blska. Z\u00e1sada m\u016f\u017ee b\u00fdt poru\u0161ena, pokud \u0159editel vyu\u017eije sv\u00e9ho pobytu k \u0159\u00edzen\u00ed spole\u010dnosti p\u0159\u00edmo ze \u0161pan\u011blsk\u00e9ho \u00fazem\u00ed.<\/p>\n<h2> Digit\u00e1ln\u00ed nom\u00e1di ve \u0160pan\u011blsku a dvoj\u00ed zdan\u011bn\u00ed<\/h2>\n<p> Jedn\u00edm z nej\u010dast\u011bj\u0161\u00edch probl\u00e9m\u016f, kter\u00fdm digit\u00e1ln\u00ed nom\u00e1di \u010del\u00ed, je riziko dvoj\u00edho zdan\u011bn\u00ed. Ke dvoj\u00edmu zdan\u011bn\u00ed v z\u00e1sad\u011b doch\u00e1z\u00ed, kdy\u017e dv\u011b nebo v\u00edce zem\u00ed vy\u017eaduj\u00ed, aby byly dan\u011b ze stejn\u00e9ho p\u0159\u00edjmu placeny. Probl\u00e9m se m\u016f\u017ee zhor\u0161it, pokud je digit\u00e1ln\u00ed nom\u00e1d zam\u011bstn\u00e1n spole\u010dnost\u00ed se s\u00eddlem v jeho domovsk\u00e9 zemi, ale fyzicky pracuje ze \u0160pan\u011blska.
