D\u016fvodem je rostouc\u00ed obliba digit\u00e1ln\u00edch platforem pro zve\u0159ej\u0148ov\u00e1n\u00ed a rezervaci turistick\u00fdch a sez\u00f3nn\u00edch pron\u00e1jm\u016f a snaha st\u00e1tu tento sektor sjednotit a kontrolovat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Od 1. \u010dervence 2025 funguje ve \u0160pan\u011blsku Jednotn\u00fd digit\u00e1ln\u00ed registr pron\u00e1jm\u016f \u2013 syst\u00e9m pro centralizovan\u00fd sb\u011br a v\u00fdm\u011bnu dat. Jednou z kl\u00ed\u010dov\u00fdch novinek je povinn\u00e1 registrace v\u0161ech nemovitost\u00ed nab\u00edzen\u00fdch k <a href=\"https:\/\/alegria-realestate.com\/cs\/service\/rent-out-property-in-spain\">turistick\u00e9mu nebo sez\u00f3nn\u00edmu pron\u00e1jmu<\/a>. Registr zaji\u0161\u0165uje \u0159\u00e1dnou identifikaci objekt\u016f a usnad\u0148uje dohled m\u00edstn\u00edch a st\u00e1tn\u00edch org\u00e1n\u016f.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Digit\u00e1ln\u00ed platformy (Booking, Tripadvisor, Expedia, Airbnb, Vrbo\/HomeAway) mus\u00ed s Registrem pravideln\u011b sd\u00edlet data, aby se zajistilo dodr\u017eov\u00e1n\u00ed p\u0159edpis\u016f a odhalov\u00e1n\u00ed poru\u0161en\u00ed. Konkr\u00e9tn\u011b lze zve\u0159ej\u0148ovat inzer\u00e1ty pouze pro objekty, kter\u00e9 z\u00edskaly \u010d\u00edslo NRU \u2013 N\u00famero de Registro \u00danico, i kdy\u017e maj\u00ed platnou turistickou licenci.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Rozli\u0161ujeme dva typy kr\u00e1tkodob\u00e9ho pron\u00e1jmu: sez\u00f3nn\u00ed a turistick\u00fd.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Sez\u00f3nn\u00ed pron\u00e1jem<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Viviendas de uso temporal \u2013 bydlen\u00ed neur\u010den\u00e9 k trval\u00e9mu pobytu, ale k pokryt\u00ed do\u010dasn\u00fdch pot\u0159eb (studenti, do\u010dasn\u00ed\/sez\u00f3nn\u00ed pracovn\u00edci, osoby na l\u00e9\u010db\u011b apod.) \u2013 na dobu od 31 dn\u016f do 9 m\u011bs\u00edc\u016f.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">V t\u011bchto p\u0159\u00edpadech nejsou vy\u017eadov\u00e1na \u017e\u00e1dn\u00e1 dal\u0161\u00ed povolen\u00ed ani informace od autonomi\u00ed nebo obc\u00ed. Uplat\u0148uje se <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1994-26003\">z\u00e1kon \u010d. 29\/1994 o m\u011bstsk\u00fdch n\u00e1jmech<\/a>.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Turistick\u00fd pron\u00e1jem<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Viviendas de uso tur\u00edstico \u2013 ubytov\u00e1n\u00ed pro turistick\u00e9 pobyty do 30 dn\u016f, \u0159\u00edzen\u00e9 zvl\u00e1\u0161tn\u00edmi p\u0159edpisy autonomn\u00edch spole\u010denstv\u00ed nebo obc\u00ed. M\u00edstn\u00ed org\u00e1ny zaji\u0161\u0165uj\u00ed dohled a mohou stanovit vlastn\u00ed pravidla.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pozn.: Ve Valencijsk\u00e9m spole\u010denstv\u00ed se za turistick\u00fd pron\u00e1jem pova\u017euje pobyt do 10 po sob\u011b jdouc\u00edch dn\u00ed (noc\u00ed) pro jednoho n\u00e1jemce; po registraci jako turistick\u00e9 ubytov\u00e1n\u00ed nejsou jin\u00e9 typy smluv dovoleny.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Viviendas de uso temporal: z\u00edsk\u00e1n\u00ed NRU<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Je t\u0159eba uv\u00e9st:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\">katastr\u00e1ln\u00ed \u010d\u00edslo a p\u0159esnou adresu;<\/li>\n<li style=\"font-weight: 400;\">zda se pronaj\u00edm\u00e1 cel\u00fd objekt, nebo pokoje;<\/li>\n<li style=\"font-weight: 400;\">maxim\u00e1ln\u00ed kapacitu osob.<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u017d\u00e1dost o NRU se pod\u00e1v\u00e1 p\u0159es web <\/span><a href=\"https:\/\/sede.registradores.org\/sede\/sede-corpme-web\/home\"><span style=\"font-weight: 400;\">Colegio de Registradores<\/span><\/a><span style=\"font-weight: 400;\">, s vyu\u017eit\u00edm elektronick\u00e9ho certifik\u00e1tu. Prozat\u00edmn\u00ed \u010d\u00edslo je p\u0159id\u011bleno ihned a po kontrole se m\u011bn\u00ed na trval\u00e9. \u010c\u00edslo je nutn\u00e9 uv\u00e1d\u011bt na v\u0161ech platform\u00e1ch se sez\u00f3nn\u00edm pron\u00e1jmem.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Viviendas de uso tur\u00edstico: z\u00edsk\u00e1n\u00ed NRU<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Je t\u0159eba:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\">katastr\u00e1ln\u00ed \u010d\u00edslo a p\u0159esnou adresu;<\/li>\n<li style=\"font-weight: 400;\">uv\u00e9st, zda se pronaj\u00edm\u00e1 cel\u00fd objekt nebo pokoje (v n\u011bkter\u00fdch autonomi\u00edch nen\u00ed pron\u00e1jem po pokoj\u00edch povolen);<\/li>\n<li style=\"font-weight: 400;\">uv\u00e9st maxim\u00e1ln\u00ed kapacitu;<\/li>\n<li style=\"font-weight: 400;\">splnit po\u017eadavky m\u00edstn\u00ed legislativy.<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">NRU se \u017e\u00e1d\u00e1 p\u0159es <\/span><a href=\"https:\/\/sede.registradores.org\/sede\/sede-corpme-web\/home\"><span style=\"font-weight: 400;\">Colegio de Registradores<\/span><\/a><span style=\"font-weight: 400;\"> s elektronick\u00fdm certifik\u00e1tem; po kontrol\u00e1ch je \u010d\u00edslo trval\u00e9. Uv\u00e1d\u00ed se ve v\u0161ech inzer\u00e1tech turistick\u00fdch pron\u00e1jm\u016f.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Pravomoci spole\u010denstv\u00ed vlastn\u00edk\u016f (comunidad de propietarios)<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Od dubna 2025 je novou \u010dinnost v oblasti sez\u00f3nn\u00edho \u010di turistick\u00e9ho pron\u00e1jmu mo\u017en\u00e9 zah\u00e1jit jen se souhlasem alespo\u0148 60 % vlastn\u00edk\u016f. V\u0161echna rozhodnut\u00ed o kr\u00e1tkodob\u00e9m pron\u00e1jmu (povolen\u00ed, omezen\u00ed, z\u00e1kaz) vy\u017eaduj\u00ed 3\/5 (60 %) hlas\u016f a pod\u00edl\u016f na spole\u010dn\u00fdch \u010d\u00e1stech.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Shrom\u00e1\u017ed\u011bn\u00ed m\u016f\u017ee rovn\u011b\u017e schv\u00e1lit nav\u00fd\u0161en\u00ed p\u0159\u00edsp\u011bvku a\u017e o 20 % pro jednotky ur\u010den\u00e9 ke kr\u00e1tkodob\u00fdm pron\u00e1jm\u016fm.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">V\u00fdchoz\u00ed stav: kr\u00e1tkodob\u00fd pron\u00e1jem je zak\u00e1z\u00e1n, dokud jej shrom\u00e1\u017ed\u011bn\u00ed neschv\u00e1l\u00ed v\u00fd\u0161e uvedenou v\u011bt\u0161inou. Licence vydan\u00e9 p\u0159ed 3. 4. 2025 z\u016fst\u00e1vaj\u00ed platn\u00e9; n\u011bkter\u00e9 obce (nap\u0159. Barcelona) v\u0161ak ozn\u00e1mily, \u017ee je po vypr\u0161en\u00ed nebudou prodlu\u017eovat. Sledujte proto lok\u00e1ln\u00ed zm\u011bny, abyste p\u0159ede\u0161li sankc\u00edm.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Kr\u00e1tkodob\u00fd turistick\u00fd pron\u00e1jem a DPH<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Od 1. \u010dervence 2028 bude <a href=\"https:\/\/alegria-realestate.com\/cs\/articles\/all-about-vat-in-spain\"><span style=\"font-weight: 400;\">DPH<\/span><\/a> povinn\u00e1 pro v\u0161echny druhy kr\u00e1tkodob\u00fdch turistick\u00fdch pron\u00e1jm\u016f (do 30 dn\u016f), i bez poskytov\u00e1n\u00ed hotelov\u00fdch slu\u017eeb.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pronaj\u00edmatel\u00e9 se mus\u00ed registrovat jako OSV\u010c (aut\u00f3nomo), aby mohli odv\u00e1d\u011bt DPH a vystavovat faktury; d\u00e1le v\u00e9st evidenci a uchov\u00e1vat dokumenty min. 4 roky.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">O\u010dek\u00e1van\u00e1 sazba je 10 % \u2013 obdobn\u011b jako u jin\u00fdch turistick\u00fdch slu\u017eeb.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Turistick\u00e1 licence ve \u0160pan\u011blsku<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Krom\u011b NRU vy\u017eaduje turistick\u00fd pron\u00e1jem licenci dle pravidel regionu, kde se nemovitost nach\u00e1z\u00ed. P\u0159edpisy se v\u00fdrazn\u011b li\u0161\u00ed a \u010dasto m\u011bn\u00ed \u2013 je nutn\u00e9 je pr\u016fb\u011b\u017en\u011b ov\u011b\u0159ovat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regulace m\u016f\u017ee spadat nejen do kompetence autonomn\u00edch spole\u010denstv\u00ed, ale i n\u011bkter\u00fdch radnic; jednotn\u00e1 celost\u00e1tn\u00ed licence neexistuje.<\/span><br \/>\n<span style=\"font-weight: 400;\">\u010cast\u00e9 po\u017eadavky:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\">registrace v turistick\u00e9m rejst\u0159\u00edku;<\/li>\n<li style=\"font-weight: 400;\">technick\u00e9, bezpe\u010dnostn\u00ed a habitabilitn\u00ed normy;<\/li>\n<li style=\"font-weight: 400;\">minim\u00e1ln\u00ed vybaven\u00ed (n\u00e1bytek, n\u00e1dob\u00ed, lo\u017en\u00ed pr\u00e1dlo, ru\u010dn\u00edky, z\u00e1kladn\u00ed spot\u0159ebi\u010de; n\u011bkdy klimatizace \u010di topen\u00ed);<\/li>\n<li style=\"font-weight: 400;\">energie a slu\u017eby (voda, elekt\u0159ina, internet);<\/li>\n<li style=\"font-weight: 400;\">poji\u0161t\u011bn\u00ed odpov\u011bdnosti;<\/li>\n<li style=\"font-weight: 400;\">identifika\u010dn\u00ed tabulka s registra\u010dn\u00edm \u010d\u00edslem (kde je vy\u017eadov\u00e1na);<\/li>\n<li style=\"font-weight: 400;\">evidence host\u016f a kniha st\u00ed\u017enost\u00ed;<\/li>\n<li style=\"font-weight: 400;\">jasn\u00e9 ceny a podm\u00ednky.<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Specifick\u00e9 po\u017eadavky mohou zahrnovat evakua\u010dn\u00ed pl\u00e1n a hasic\u00ed p\u0159\u00edstroje na v\u0161ech podla\u017e\u00edch; 24\/7 kontaktn\u00ed \u010d\u00edslo; z\u00e1kaz\/povolen\u00ed pron\u00e1jmu po pokoj\u00edch (s povinnou\/nepovinnou p\u0159\u00edtomnost\u00ed majitele); zatem\u0148ovac\u00ed z\u00e1v\u011bsy\/\u017ealuzie; bezbari\u00e9rovost.<\/span><br \/>\n<span style=\"font-weight: 400;\">Z\u00e1kladn\u00ed bal\u00ed\u010dek dokument\u016f:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\">\u010destn\u00e9 prohl\u00e1\u0161en\u00ed (Declaraci\u00f3n Responsable);<\/li>\n<li style=\"font-weight: 400;\">kopie DNI\/NIE;<\/li>\n<li style=\"font-weight: 400;\">doklad o vlastnictv\u00ed \u010di u\u017e\u00edvac\u00edm pr\u00e1vu (kupn\u00ed smlouva, <a href=\"https:\/\/alegria-realestate.com\/cs\/articles\/all-about-nota-simple-in-spain\">v\u00fdpis z katastru \u2013 Nota Simple<\/a>, n\u00e1jemn\u00ed smlouva s pr\u00e1vem podn\u00e1jmu atd.);<\/li>\n<li style=\"font-weight: 400;\">osv\u011bd\u010den\u00ed o obyvatelnosti\/licence k prvn\u00edmu u\u017e\u00edv\u00e1n\u00ed;<\/li>\n<li style=\"font-weight: 400;\">p\u016fdorys;<\/li>\n<li style=\"font-weight: 400;\">poji\u0161t\u011bn\u00ed odpov\u011bdnosti pokr\u00fdvaj\u00edc\u00ed turistick\u00fd pron\u00e1jem;<\/li>\n<li style=\"font-weight: 400;\">doklad o zaplacen\u00ed poplatku (je-li vy\u017eadov\u00e1n);<\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/alegria-realestate.com\/cs\/articles\/all-about-energy-certificate-in-spain\">energetick\u00fd pr\u016fkaz<\/a>;<\/li>\n<li style=\"font-weight: 400;\">souhlas spole\u010denstv\u00ed vlastn\u00edk\u016f (stanovy nebo z\u00e1pis).<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Spr\u00e1vn\u00ed \u0159\u00edzen\u00ed je obvykle jednoduch\u00e9 a prob\u00edh\u00e1 online. \u010c\u00edslo licence se uv\u00e1d\u00ed na tabulce a ve v\u0161ech inzer\u00e1tech.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Pokuty za absenci turistick\u00e9 licence a \u010d\u00edsla NRU<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">V roce 2025 se zp\u0159\u00edsnila kontrola turistick\u00fdch pron\u00e1jm\u016f a pokuty v\u00fdrazn\u011b vzrostly. V\u00fd\u0161e se li\u0161\u00ed dle regionu a z\u00e1va\u017enosti:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\">St\u00e1t: za chyb\u011bj\u00edc\u00ed NRU 2.000\u2013500.000 \u20ac; nejvy\u0161\u0161\u00ed sankce p\u0159i opakov\u00e1n\u00ed nebo dlouhodob\u00e9m neleg\u00e1ln\u00edm pron\u00e1jmu.<\/li>\n<li style=\"font-weight: 400;\">Za zve\u0159ejn\u011bn\u00ed
