Z\u00e1v\u011b\u0165 je tedy ve \u0160pan\u011blsku \u00fakon (napsan\u00fd samotn\u00fdm z\u016fstavitelem, t\u0159et\u00ed osobou nebo dokonce \u00fastn\u011b), ve kter\u00e9m osoba uv\u00e1d\u00ed, komu p\u0159ipadne cel\u00fd nebo \u010d\u00e1st jej\u00edho majetku.<\/p>\n<h2> Wills ve \u0160pan\u011blsku: Kl\u00ed\u010dov\u00e9 body<\/h2>\n<p> Ve \u0160pan\u011blsku existuj\u00ed dva z\u00e1klady d\u011bd\u011bn\u00ed: ze z\u00e1kona (heredero) a ze z\u00e1v\u011bti (legatario). D\u011bdicem ze z\u00e1kona m\u016f\u017ee b\u00fdt fyzick\u00e1 nebo pr\u00e1vnick\u00e1 osoba, kter\u00e1 m\u00e1 pr\u00e1vo na ve\u0161ker\u00fd majetek a z\u00e1vazky (nebo jejich \u010d\u00e1st), kter\u00e9 tvo\u0159\u00ed d\u011bdictv\u00ed po zem\u0159el\u00e9m. Absence z\u00e1v\u011bti neru\u0161\u00ed jejich pr\u00e1va na <a href=\"https:\/\/alegria-realestate.com\/ru\/articles\/inheritance-in-spain\">d\u011bdictv\u00ed.<\/a> D\u011bdicem ze z\u00e1v\u011bti m\u016f\u017ee b\u00fdt tak\u00e9 fyzick\u00e1 nebo pr\u00e1vnick\u00e1 osoba, v tomto p\u0159\u00edpad\u011b v\u0161ak nehovo\u0159\u00edme o cel\u00e9m d\u011bdictv\u00ed nebo jeho \u010d\u00e1sti, ale o konkr\u00e9tn\u00ed v\u011bci nebo pr\u00e1vu p\u0159\u00edmo p\u0159edepsan\u00e9m v z\u00e1v\u011bti. Z\u00e1sadn\u00ed rozd\u00edl mezi t\u011bmito dv\u011bma typy d\u011bdic\u016f je v tom, \u017ee v p\u0159\u00edpad\u011b neexistence z\u00e1v\u011bti se d\u011bdic (d\u011bdicov\u00e9) ze z\u00e1kona ur\u010d\u00ed podle sou\u010dasn\u00e9 pr\u00e1vn\u00ed \u00fapravy, zat\u00edmco d\u011bdic ze z\u00e1v\u011bti vznik\u00e1 pouze projevem v\u016fle z\u016fstavitele. Na rozd\u00edl od mnoha jin\u00fdch \u00fa\u0159edn\u00edch dokument\u016f, kter\u00e9 mohou b\u00fdt podle z\u00e1konn\u00fdch po\u017eadavk\u016f podeps\u00e1ny pouze dosp\u011bl\u00fdmi osobami, plat\u00ed pro z\u00e1v\u011bti jin\u00e9 pravidlo: z\u00e1v\u011b\u0165 ve \u0160pan\u011blsku m\u016f\u017ee sepsat a podepsat jak\u00e1koli kompetentn\u00ed osoba star\u0161\u00ed 14 let, ani\u017e by k tomu bylo nutn\u00e9 z\u00edskat jak\u00fdkoli souhlas rodi\u010d\u016f nebo opatrovn\u00edk\u016f.<\/p>\n<h2> Hlavn\u00ed charakteristiky z\u00e1v\u011bti ve \u0160pan\u011blsku<\/h2>\n<p> Z\u00e1v\u011b\u0165 je ve \u0160pan\u011blsku pr\u00e1vn\u00ed dokument, co\u017e je v podstat\u011b dispozice u\u010din\u011bn\u00e1 svobodn\u011b a dobrovoln\u011b konkr\u00e9tn\u00ed osobou. V tomto p\u0159\u00edpad\u011b m\u016f\u017ee b\u00fdt pouze jeden z\u016fstavitel: dv\u011b nebo v\u00edce osob nemohou spole\u010dn\u011b sepsat z\u00e1v\u011b\u0165 ani zahrnout sv\u00e9 pokyny t\u00fdkaj\u00edc\u00ed se majetku a pr\u00e1v do jednoho dokumentu. Z\u00e1v\u011b\u0165 je nav\u00edc osobn\u00ed \u00fakon: nelze ji po\u0159\u00eddit prost\u0159ednictv\u00edm z\u00e1stupce nebo d\u016fv\u011bryhodn\u00e9 osoby. Ustanoven\u00ed d\u011bdic\u016f (heredero a legatario), stejn\u011b jako ur\u010den\u00ed pod\u00edl\u016f, nelze ponechat na uv\u00e1\u017een\u00ed t\u0159et\u00ed osoby. Kdy\u017e se v rozhovoru zm\u00edn\u00ed, \u017ee man\u017eel\u00e9 sepsali spole\u010dnou z\u00e1v\u011b\u0165, m\u011blo by se ch\u00e1pat, \u017ee budou z\u00e1v\u011bti dv\u011b \u2013 jedna pro ka\u017ed\u00e9ho z man\u017eel\u016f. Ka\u017ed\u00fd z man\u017eel\u016f m\u00e1 p\u0159itom pr\u00e1vo kdykoli bez v\u011bdom\u00ed druh\u00e9ho man\u017eela svou osobn\u00ed v\u016fli dle vlastn\u00edho uv\u00e1\u017een\u00ed zm\u011bnit nebo zcela zru\u0161it. Posledn\u00ed v\u016fle je platn\u00e1 a nen\u00ed-li uvedeno jinak, ru\u0161\u00ed p\u0159edchoz\u00ed z\u00e1v\u011b\u0165. Vzhledem k tomu, \u017ee z\u00e1v\u011b\u0165 nab\u00fdv\u00e1 pr\u00e1vn\u00ed moci a\u017e po smrti, m\u00e1 z\u016fstavitel pr\u00e1vo za sv\u00e9ho \u017eivota d\u00e1le nakl\u00e1dat se sv\u00fdm majetkem bez omezen\u00ed a bez ohledu na to, co a komu odk\u00e1zal. Nic mu nap\u0159\u00edklad nebr\u00e1n\u00ed prodat sv\u016fj d\u016fm, i kdy\u017e se to v textu z\u00e1v\u011bti objev\u00ed. Krom\u011b zm\u00ednky o majetku nebo pr\u00e1vech m\u016f\u017ee z\u00e1v\u011b\u0165 obsahovat i dal\u0161\u00ed z\u00e1le\u017eitosti, kter\u00e9 jsou pro z\u016fstavitele d\u016fle\u017eit\u00e9. Nap\u0159\u00edklad:<\/p>\n<ul>\n<li> Rozpozn\u00e1v\u00e1n\u00ed d\u011bt\u00ed;<\/li>\n<li> Jmenov\u00e1n\u00ed nebo vylou\u010den\u00ed opatrovn\u00edk\u016f nebo spr\u00e1vc\u016f majetku nezletil\u00fdch d\u011bt\u00ed;<\/li>\n<li> Zru\u0161en\u00ed p\u0159edchoz\u00ed z\u00e1v\u011bti.<\/li>\n<\/ul>\n<h2> Typy z\u00e1v\u011bt\u00ed ve \u0160pan\u011blsku<\/h2>\n<p> Z\u00e1v\u011bti se ve \u0160pan\u011blsku d\u011bl\u00ed do t\u0159\u00ed kategori\u00ed: obecn\u00e9, zvl\u00e1\u0161tn\u00ed a v\u00fdjime\u010dn\u00e9. Kategorie obecn\u00fdch z\u00e1v\u011bt\u00ed zahrnuje:<\/p>\n<ul>\n<li> <strong>Ru\u010dn\u011b psan\u00e9 z\u00e1v\u011bti:<\/strong> nevy\u017eaduj\u00ed sv\u011bdky, jsou seps\u00e1ny a podeps\u00e1ny samotn\u00fdm z\u016fstavitelem, mus\u00ed obsahovat jasn\u00fd a srozumiteln\u00fd projev v\u016fle, jako\u017e i m\u00edsto a datum vyhotoven\u00ed. Ke v\u0161em oprav\u00e1m, v\u00fdmaz\u016fm a v\u00fdmaz\u016fm mus\u00ed b\u00fdt p\u0159ipojen koment\u00e1\u0159 a podpis z\u016fstavitele. Opatrovatel z\u00e1v\u011bti je povinen ji p\u0159edlo\u017eit not\u00e1\u0159i k ov\u011b\u0159en\u00ed do 10 dn\u016f ode dne, kdy se o smrti z\u016fstavitele dozv\u011bd\u011bl.<\/li>\n<li> <strong>Otev\u0159en\u00e1 z\u00e1v\u011b\u0165:<\/strong> sepisuje jak\u00e1koli zp\u016fsobil\u00e1 osoba star\u0161\u00ed 14 let za p\u0159\u00edtomnosti not\u00e1\u0159e. \u00da\u010dast sv\u011bdk\u016f nen\u00ed nutn\u00e1. Origin\u00e1l z\u00e1v\u011bti je ulo\u017een v not\u00e1\u0159sk\u00e9 kancel\u00e1\u0159i; z\u016fstavitel m\u016f\u017ee obdr\u017eet prost\u00fd opis. Z\u00e1v\u011b\u0165 je tak\u00e9 zaps\u00e1na do V\u0161eobecn\u00e9ho rejst\u0159\u00edku posledn\u00edch v\u016fl\u00ed a z\u00e1v\u011bt\u00ed.<\/li>\n<li> <strong>Uzav\u0159en\u00e1 z\u00e1v\u011b\u0165:<\/strong> sepisuje z\u016fstavitel s\u00e1m, bu\u010f ru\u010dn\u011b nebo mechanicky, s podpisem na v\u0161ech str\u00e1nk\u00e1ch. Vypln\u011bn\u00e1 z\u00e1v\u011b\u0165 se vlo\u017e\u00ed do ob\u00e1lky a bu\u010f se v uzav\u0159en\u00e9 podob\u011b p\u0159ed\u00e1 not\u00e1\u0159i, nebo se za jeho p\u0159\u00edtomnosti zape\u010de\u0165uje. Not\u00e1\u0159 provede p\u0159\u00edslu\u0161n\u00fd registra\u010dn\u00ed z\u00e1znam a samotnou ob\u00e1lku si m\u016f\u017ee ponechat s\u00e1m z\u016fstavitel, p\u0159\u00edpadn\u011b not\u00e1\u0159 \u010di t\u0159et\u00ed osoba. Po obdr\u017een\u00ed ozn\u00e1men\u00ed o \u00famrt\u00ed z\u016fstavitele je not\u00e1\u0159 povinen do 10 dn\u016f ozn\u00e1mit existenci z\u00e1v\u011bti man\u017eelovi, p\u0159\u00edbuzn\u00fdm v sestupn\u00e9 nebo vzestupn\u00e9 linii nebo dal\u0161\u00edm p\u0159\u00edbuzn\u00fdm.<\/li>\n<\/ul>\n<p> Kategorie zvl\u00e1\u0161tn\u00edch z\u00e1v\u011bt\u00ed zahrnuje:<\/p>\n<ul>\n<li> <strong>Z\u00e1v\u011bti pro vojensk\u00e1 ta\u017een\u00ed:<\/strong> sepisuj\u00ed aktivn\u00edm vojensk\u00fdm person\u00e1lem nebo dobrovoln\u00edky za p\u0159\u00edtomnosti dvou sv\u011bdk\u016f z ur\u010den\u00e9ho seznamu osob. Platnost takov\u00e9 z\u00e1v\u011bti automaticky vypr\u0161\u00ed 4 m\u011bs\u00edce po n\u00e1vratu voj\u00e1ka.<\/li>\n<li> <strong>N\u00e1mo\u0159n\u00ed a n\u00e1mo\u0159n\u00ed z\u00e1v\u011bti:<\/strong> Mohou b\u00fdt vyhotoveny jakoukoli osobou na palub\u011b n\u00e1mo\u0159n\u00edho plavidla (vojensk\u00e9ho nebo obchodn\u00edho) b\u011bhem plavby, a\u0165 u\u017e jde o cestuj\u00edc\u00ed nebo \u010dlena pos\u00e1dky, a mus\u00ed b\u00fdt potvrzeny kapit\u00e1nem nebo vel\u00edc\u00edm d\u016fstojn\u00edkem. Platnost takov\u00fdch z\u00e1v\u011bt\u00ed automaticky vypr\u0161\u00ed 4 m\u011bs\u00edce pot\u00e9, co z\u016fstavitel ostrov opust\u00ed.<\/li>\n<li> <strong>Z\u00e1v\u011b\u0165 po\u0159\u00edzen\u00e1 mimo \u0160pan\u011blsko:<\/strong> \u0160pan\u011bl\u0161t\u00ed ob\u010dan\u00e9 mohou po\u0159\u00eddit z\u00e1v\u011b\u0165 mimo st\u00e1tn\u00ed \u00fazem\u00ed za p\u0159edpokladu, \u017ee dodr\u017e\u00ed formul\u00e1\u0159e stanoven\u00e9 z\u00e1kony zem\u011b, ve kter\u00e9 se nach\u00e1zej\u00ed. Mohou sepsat z\u00e1v\u011b\u0165 na voln\u00e9m mo\u0159i, zat\u00edmco jsou na ciz\u00ed lodi, v souladu se z\u00e1kony zem\u011b, kter\u00e9 lo\u010f pat\u0159\u00ed. Mohou tak\u00e9 po\u0159\u00eddit p\u00edsemnou z\u00e1v\u011b\u0165, psanou vlastn\u00ed rukou, a to i v zem\u00edch, jejich\u017e z\u00e1kony takovou z\u00e1v\u011b\u0165 neumo\u017e\u0148uj\u00ed. Kone\u010dn\u011b \u0161pan\u011bl\u0161t\u00ed ob\u010dan\u00e9, kte\u0159\u00ed se nach\u00e1zej\u00ed v jin\u00e9 zemi, mohou sepsat svou otev\u0159enou nebo uzav\u0159enou z\u00e1v\u011b\u0165 v p\u0159\u00edtomnosti \u00fa\u0159edn\u00edka \u0161pan\u011blsk\u00e9 diplomatick\u00e9 mise nebo konzul\u00e1tu, kter\u00fd vykon\u00e1v\u00e1 not\u00e1\u0159sk\u00e9 funkce.<\/li>\n<\/ul>\n<p> Kategorie v\u00fdhradn\u00edch z\u00e1v\u011bt\u00ed zahrnuje:<\/p>\n<ul>\n<li> <strong>Z\u00e1v\u011b\u0165 sepsan\u00e1 v ciz\u00edm jazyce:<\/strong> pokud z\u016fstavitel sep\u00ed\u0161e svou z\u00e1v\u011b\u0165 v jazyce, kter\u00fd not\u00e1\u0159 neovl\u00e1d\u00e1, je nutn\u00e1 p\u0159\u00edtomnost tlumo\u010dn\u00edka, kter\u00fd p\u0159elo\u017e\u00ed text z\u00e1v\u011bti do \u00fa\u0159edn\u00edho jazyka m\u00edsta vyd\u00e1n\u00ed, kter\u00fd not\u00e1\u0159 pou\u017e\u00edv\u00e1. Z\u00e1v\u011bre\u010dn\u00fd dokument bude vyhotoven v obou jazyc\u00edch s uveden\u00edm jazyka, kter\u00fd z\u016fstavitel pou\u017eil. Ciz\u00ed ob\u010dan\u00e9 mohou sepsat p\u00edsemnou z\u00e1v\u011b\u0165, ru\u010dn\u011b psanou ve sv\u00e9m rodn\u00e9m jazyce.<\/li>\n<li> <strong>Z\u00e1v\u011bti po\u0159\u00edzen\u00e9 osobou, kter\u00e1 um\u00edr\u00e1:<\/strong> nap\u0159\u00edklad kdy\u017e not\u00e1\u0159 nem\u016f\u017ee p\u0159ij\u00edt do nemocnice za um\u00edraj\u00edc\u00edm. V tomto p\u0159\u00edpad\u011b bude vy\u017eadov\u00e1no 5 sv\u011bdk\u016f, kte\u0159\u00ed nejsou sou\u010d\u00e1st\u00ed okruhu p\u0159\u00edbuzn\u00fdch nebo zainteresovan\u00fdch stran. Do 3 m\u011bs\u00edc\u016f ode dne smrti z\u016fstavitele (pokud od seps\u00e1n\u00ed z\u00e1v\u011bti do dne smrti neuplynou v\u00edce ne\u017e 2 m\u011bs\u00edce) je nutn\u00e9 kontaktovat not\u00e1\u0159e, aby z\u00e1v\u011b\u0165 dal status ve\u0159ejn\u00e9 listiny.<\/li>\n<li> <strong>Z\u00e1v\u011b\u0165 po\u0159\u00edzen\u00e1 pro p\u0159\u00edpad epidemie:<\/strong> Ka\u017ed\u00e1 osoba, kter\u00e1 se nach\u00e1z\u00ed v m\u00edst\u011b, kde byla epidemie vyhl\u00e1\u0161ena, m\u016f\u017ee zanechat z\u00e1v\u011b\u0165 po\u0159\u00edzenou za p\u0159\u00edtomnosti 3 sv\u011bdk\u016f. Do 3 m\u011bs\u00edc\u016f ode dne smrti z\u016fstavitele (pokud od seps\u00e1n\u00ed z\u00e1v\u011bti do dne smrti neuplynou v\u00edce ne\u017e 2 m\u011bs\u00edce) je nutn\u00e9 kontaktovat not\u00e1\u0159e, aby z\u00e1v\u011b\u0165 dal status ve\u0159ejn\u00e9 listiny.<\/li>\n<\/ul>\n<h2> Kdy m\u016f\u017ee b\u00fdt z\u00e1v\u011b\u0165 ve \u0160pan\u011blsku zneplatn\u011bna<\/h2>\n<p> Z\u00e1v\u011b\u0165 ve \u0160pan\u011blsku nem\u00e1 pr\u00e1vn\u00ed s\u00edlu, pokud:<\/p>\n<ul>\n<li> Byl seps\u00e1n v rozporu s po\u017eadavky platn\u00e9 pr\u00e1vn\u00ed \u00fapravy nap\u0159. t\u0159et\u00ed osobou, osobou s omezenou zp\u016fsobilost\u00ed k pr\u00e1vn\u00edm \u00fakon\u016fm, dv\u011bma nebo v\u00edce osobami spole\u010dn\u011b, pod n\u00e1tlakem, proti v\u016fli z\u016fstavitele, se zl\u00fdm \u00famyslem apod.<\/li>\n<li> Bylo zru\u0161eno z\u016fstavitelem, nebo existuje pozd\u011bj\u0161\u00ed z\u00e1v\u011b\u0165.<\/li>\n<li> Byl seps\u00e1n ve prosp\u011bch bl\u00ed\u017ee neur\u010den\u00e9 osoby, jej\u00ed\u017e toto\u017enost nelze zjistit.<\/li>\n<li> Byl seps\u00e1n ve prosp\u011bch osoby s omezenou zp\u016fsobilost\u00ed k pr\u00e1vn\u00edm \u00fakon\u016fm.<\/li>\n<li> Pot\u0159ebn\u00e9 formality k platnosti z\u00e1v\u011bti nebyly dodr\u017eeny.<\/li>\n<\/ul>\n<h2> Kolik stoj\u00ed seps\u00e1n\u00ed z\u00e1v\u011bti ve \u0160pan\u011blsku u not\u00e1\u0159e<\/h2>\n<p> Z\u00e1v\u011bti sepsan\u00e9 not\u00e1\u0159em se li\u0161\u00ed v cen\u011b: cena z\u00e1vis\u00ed na typu dokumentu. Nejdra\u017e\u0161\u00ed bude z\u00e1v\u011b\u0165 psan\u00e1 vlastnoru\u010dn\u011b, proto\u017ee vy\u017eaduje, aby bylo provedeno v\u00edce administrativn\u00edch postup\u016f, aby bylo uzn\u00e1no za platn\u00e9. Pokud mluv\u00edme o b\u011b\u017en\u00e9 otev\u0159en\u00e9 z\u00e1v\u011bti, jej\u00ed cena se pohybuje kolem 40-50 eur. Upozor\u0148ujeme, \u017ee pro seps\u00e1n\u00ed z\u00e1v\u011bti not\u00e1\u0159sk\u00fdm zp\u016fsobem se m\u016f\u017eete obr\u00e1tit na kter\u00e9hokoli not\u00e1\u0159e bez ohledu na m\u00edsto va\u0161eho bydli\u0161t\u011b.<\/p>\n<h2> D\u011bd\u011bn\u00ed z\u00e1v\u011bt\u00ed ve \u0160pan\u011blsku: kroky<\/h2>\n<p> <strong>Krok 1.<\/strong> Z\u00edsk\u00e1n\u00ed l\u00e9ka\u0159sk\u00e9ho \u00famrtn\u00edho listu. Pokud k \u00famrt\u00ed z\u016fstavitele do\u0161lo ve \u0160pan\u011blsku, prvn\u00edm krokem bude z\u00edsk\u00e1n\u00ed l\u00e9ka\u0159sk\u00e9ho \u00famrtn\u00edho listu. Tento doklad vystavuje zdarma l\u00e9ka\u0159, kter\u00fd potvrdil \u00famrt\u00ed. <strong>Krok 2.<\/strong> Z\u00e1pis skute\u010dnosti \u00famrt\u00ed do ob\u010dansk\u00e9ho rejst\u0159\u00edku (Registro Civil). Pokud byl z\u016fstavitel \u0161pan\u011blsk\u00fd ob\u010dan, je nutn\u00e9 zapsat \u00famrt\u00ed do matriky a z\u00edskat \u00fa\u0159edn\u00ed \u00famrtn\u00ed list. Pokud bylo osv\u011bd\u010den\u00ed vyd\u00e1no mimo \u0160pan\u011blsko a nen\u00ed ve \u0161pan\u011bl\u0161tin\u011b, mus\u00ed b\u00fdt apostilov\u00e1no (pokud dvoustrann\u00e1 dohoda nestanov\u00ed jinak) a p\u0159elo\u017eeno do \u0161pan\u011bl\u0161tiny soudn\u00edm p\u0159ekladatelem. <strong>Krok 3.<\/strong> Z\u00edsk\u00e1n\u00ed osv\u011bd\u010den\u00ed o v\u016fli (Certificado de \u00faltimas voluntades). Od 15. dne po \u00famrt\u00ed m\u016f\u017eete po\u017e\u00e1dat o potvrzen\u00ed o poz\u016fstalosti. Nejjednodu\u0161\u0161\u00ed zp\u016fsob, jak toho dos\u00e1hnout, je prost\u0159ednictv\u00edm V\u0161eobecn\u00e9ho registru posledn\u00edch v\u016fl\u00ed a z\u00e1v\u011bt\u00ed (Registro General de Actos de \u00daltima Voluntad). Cena slu\u017eby je 3,86 eur. Osv\u011bd\u010den\u00ed o z\u00e1v\u011bti je dokument, kter\u00fd osv\u011bd\u010duje, zda osoba po\u0159\u00eddila z\u00e1v\u011b\u0165, a pokud ano, u kter\u00e9ho not\u00e1\u0159e. D\u011bdicov\u00e9 si tak mohou u uveden\u00e9ho not\u00e1\u0159e vy\u017e\u00e1dat kopii z\u00e1v\u011bti nap\u0159. k proveden\u00ed jak\u00fdchkoli \u00fakon\u016f ohledn\u011b d\u011bdictv\u00ed. <strong>Krok 4.<\/strong> Z\u00edsk\u00e1n\u00ed ov\u011b\u0159en\u00e9 kopie z\u00e1v\u011bti.
