Hypot\u00e9ky ve \u0160pan\u011blsku pro Rusy a dal\u0161\u00ed ciz\u00ed ob\u010dany jsou poskytov\u00e1ny za stejn\u00fdch podm\u00ednek jako pro \u0161pan\u011blsk\u00e9 ob\u010dany. Dne 17. \u010dervna 2019 vstoupil ve \u0160pan\u011blsku v platnost nov\u00fd hypote\u010dn\u00ed z\u00e1kon, zn\u00e1m\u00fd jako Ley de Cr\u00e9dito Inmobiliario 5\/2019. Jeho p\u0159ijet\u00ed se prot\u00e1hlo v\u00edce ne\u017e t\u0159i roky: \u0161pan\u011blsk\u00e9 ministerstvo hospod\u00e1\u0159stv\u00ed za\u010dalo na z\u00e1kon\u011b pracovat u\u017e v roce 2017 pod tlakem Bruselu. Co je to z\u00e1kon a jak ovlivn\u00ed hypot\u00e9ky ve \u0160pan\u011blsku? Poj\u010fme na to p\u0159ij\u00edt. Podle po\u017eadavk\u016f Bruselu m\u011bly v\u0161echny \u010dlensk\u00e9 st\u00e1ty EU do jara 2016 vypracovat legislativu, kter\u00e1 by zahrnovala spole\u010dn\u00e9 celoevropsk\u00e9 principy v oblasti hypot\u00e9k, ale kv\u016fli nestabiln\u00ed politick\u00e9 situaci se term\u00edny nepoda\u0159ilo dodr\u017eet. Fin\u00e1ln\u00ed text nov\u00e9ho \u0161pan\u011blsk\u00e9ho hypote\u010dn\u00edho z\u00e1kona obsahuje nejen ustanoven\u00ed, kter\u00e1 je nutn\u00e9 zahrnout v souladu s bruselskou sm\u011brnic\u00ed, ale tak\u00e9 \u0159adu novinek, kter\u00e9 z vlastn\u00ed iniciativy zavedla \u0161pan\u011blsk\u00e1 vl\u00e1da a jejich\u017e c\u00edlem je zv\u00fd\u0161it bezpe\u010dnost a transparentnost hypote\u010dn\u00edch obchod\u016f jak pro banky, tak pro jejich klienty. N\u00ed\u017ee se pod\u00edv\u00e1me na kl\u00ed\u010dov\u00e9 zm\u011bny, kter\u00e9 vstoupily v platnost s nov\u00fdm z\u00e1konem.<\/p>\n<ul>\n<li> Klient je povinen minim\u00e1ln\u011b 10 dn\u016f p\u0159ed uzav\u0159en\u00edm z\u00e1stavn\u00ed smlouvy kontaktovat not\u00e1\u0159e za \u00fa\u010delem vy\u0159e\u0161en\u00ed v\u0161ech jeho pochybnost\u00ed. Banka zase mus\u00ed klientovi poskytnout smlouvu s pe\u010dliv\u011b formulovan\u00fdmi podm\u00ednkami minim\u00e1ln\u011b 10 dn\u00ed p\u0159ed podpisem. Slu\u017eba je pro klienta zdarma. Po sch\u016fzce s not\u00e1\u0159em klient podpisem zvl\u00e1\u0161tn\u00edho dokumentu stvrzuje, \u017ee v\u0161em podm\u00ednk\u00e1m smlouvy rozum\u00ed a \u017ee je p\u0159ij\u00edm\u00e1.<\/li>\n<li> Omezen\u00ed poplatk\u016f za p\u0159ed\u010dasn\u00e9 \u010d\u00e1ste\u010dn\u00e9 nebo \u00fapln\u00e9 splacen\u00ed hypot\u00e9ky. Omezen\u00ed jsou nastavena v z\u00e1vislosti na typu hypot\u00e9ky (pevn\u00e1 nebo diferencovan\u00e1 \u00farokov\u00e1 sazba) a tak\u00e9 v z\u00e1vislosti na obdob\u00ed, kdy do\u0161lo ke spl\u00e1cen\u00ed (v prvn\u00ed polovin\u011b doby hypot\u00e9ky nebo ve druh\u00e9). U hypot\u00e9k s nastavitelnou sazbou m\u016f\u017ee b\u00fdt poplatek maxim\u00e1ln\u011b 0,25 %, pokud dojde ke splacen\u00ed b\u011bhem prvn\u00edch t\u0159\u00ed let trv\u00e1n\u00ed hypot\u00e9ky, a 0,15 % od t\u0159et\u00edho do p\u00e1t\u00e9ho roku. U hypot\u00e9k s pevnou \u00farokovou sazbou je limit 2 % po dobu prvn\u00edch 10 let trv\u00e1n\u00ed smlouvy a 1,5 % pot\u00e9.<\/li>\n<li> Prodlu\u017euje se doba neplacen\u00ed, po jej\u00edm\u017e uplynut\u00ed m\u016f\u017ee banka zah\u00e1jit \u0159\u00edzen\u00ed o embargu. Toto opat\u0159en\u00ed m\u00e1 chr\u00e1nit dr\u017eitele hypot\u00e9k, kte\u0159\u00ed maj\u00ed do\u010dasn\u00e9 finan\u010dn\u00ed pot\u00ed\u017ee. Podle nov\u00e9ho z\u00e1kona m\u016f\u017ee banka vyvolat tzv. dolo\u017eku o p\u0159ed\u010dasn\u00e9m splacen\u00ed pro nespl\u00e1cen\u00ed, pokud je hypote\u010dn\u00ed \u00fav\u011br v prodlen\u00ed d\u00e9le ne\u017e 12 m\u011bs\u00edc\u016f nebo pokud dlu\u017en\u00e1 \u010d\u00e1stka \u010din\u00ed alespo\u0148 3 % z celkov\u00e9ho \u00fav\u011bru.<\/li>\n<li> Z\u00e1kaz jak\u00fdchkoli rezervac\u00ed, jako je nechvaln\u011b zn\u00e1m\u00e1 \u201ecl\u00e1usula suelo\u201c. Tato klauzule v hypote\u010dn\u00ed smlouv\u011b s pohyblivou sazbou stanovila minim\u00e1ln\u00ed sazbu a klient byl povinen spl\u00e1cet hypot\u00e9ku v souladu se stanovenou sazbou i po v\u00fdrazn\u00e9m poklesu indexu Euribor a s t\u00edm souvisej\u00edc\u00edch \u00farokov\u00fdch sazeb. V\u0161echny v sou\u010dasnosti existuj\u00edc\u00ed dolo\u017eky, kter\u00e9 odporuj\u00ed podm\u00ednk\u00e1m transparentnosti, budou zru\u0161eny.<\/li>\n<li> Zlevn\u011bn\u00ed a snadn\u011bj\u0161\u00ed p\u0159em\u011bna hypot\u00e9ky s variabiln\u00ed sazbou na hypot\u00e9ku s pevnou sazbou. Krom\u011b toho se zjednodu\u0161\u00ed postup p\u0159evodu \u00fav\u011bru poskytnut\u00e9ho v ciz\u00ed m\u011bn\u011b na eura.<\/li>\n<li> Nov\u00fd z\u00e1kon omezuje v\u00fd\u0161i poplatku z prodlen\u00ed (pen\u00e1le), kter\u00fd se nov\u011b bude vypo\u010d\u00edt\u00e1vat takto: klientem zaplacen\u00e1 \u00farokov\u00e1 sazba plus 3 % za dobu, po kterou z\u016fstane dluh neuhrazen. Krom\u011b toho lze pen\u00e1le \u00fa\u010dtovat pouze z dlu\u017en\u00e9 \u010d\u00e1stky.<\/li>\n<li> Banky maj\u00ed zak\u00e1z\u00e1no vy\u017eadovat od z\u00e1kazn\u00edk\u016f n\u00e1kup jin\u00fdch finan\u010dn\u00edch produkt\u016f, jako je poji\u0161t\u011bn\u00ed dom\u00e1cnosti nebo \u017eivotn\u00ed poji\u0161t\u011bn\u00ed, jako podm\u00ednku poskytnut\u00ed hypot\u00e9ky.<\/li>\n<li> P\u0159ehledn\u00e9 a transparentn\u00ed rozd\u011blen\u00ed n\u00e1klad\u016f na vy\u0159\u00edzen\u00ed hypot\u00e9ky: klient plat\u00ed pouze posouzen\u00ed nemovitosti a poskytnut\u00ed kopie (nebo v\u00edce kopi\u00ed) smlouvy.<\/li>\n<li> Banky jsou povinny pe\u010dliv\u011b prov\u011b\u0159it platebn\u00ed schopnost klienta, poskytnout mu podrobn\u00e9 informace o detailech obchodu, podan\u00e9 v jasn\u00e9 a srozumiteln\u00e9 form\u011b, a tak\u00e9 vy\u0159e\u0161it v\u0161echny jeho pochybnosti v pr\u016fb\u011bhu trv\u00e1n\u00ed hypote\u010dn\u00ed smlouvy. Banka mus\u00ed zejm\u00e9na prostudovat \u00fav\u011brovou historii potenci\u00e1ln\u00edho dlu\u017en\u00edka t\u00edm, \u017ee si vy\u017e\u00e1d\u00e1 informace od Informa\u010dn\u00edho centra rizik \u0160pan\u011blsk\u00e9 banky.<\/li>\n<\/ul>\n<p> Nov\u00fd hypote\u010dn\u00ed z\u00e1kon se vztahuje na v\u0161echny nov\u00e9 hypote\u010dn\u00ed \u00fav\u011bry vydan\u00e9 od nabyt\u00ed \u00fa\u010dinnosti fyzick\u00fdm osob\u00e1m a ur\u010den\u00e9 na koupi reziden\u010dn\u00edch nemovitost\u00ed (dokon\u010den\u00fdch nebo rozestav\u011bn\u00fdch) a u\u017eitkov\u00fdch budov. Z\u00e1kon podle odborn\u00edk\u016f skute\u010dn\u011b zv\u00fd\u0161\u00ed transparentnost a bezpe\u010dnost v oblasti poskytov\u00e1n\u00ed hypote\u010dn\u00edch \u00fav\u011br\u016f, ale m\u016f\u017ee v\u00e9st k vy\u0161\u0161\u00edm cen\u00e1m hypot\u00e9k a zp\u0159\u00edsn\u011bn\u00ed po\u017eadavk\u016f na banky na jejich poskytov\u00e1n\u00ed.
