M\u00edsto dlouh\u00e9ho ofici\u00e1ln\u00edho n\u00e1zvu se \u010dast\u011bji pou\u017e\u00edv\u00e1 krat\u0161\u00ed ozna\u010den\u00ed <strong>Plusval\u00eda Municipal<\/strong>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Plusval\u00eda Municipal ve \u0160pan\u011blsku pat\u0159\u00ed mezi obecn\u00ed dan\u011b; sazby, \u00falevy i mo\u017enost spl\u00e1tek se proto upravuj\u00ed na m\u00edstn\u00ed \u00farovni. V r\u016fzn\u00fdch obc\u00edch mohou transakce ve stejn\u00e9 hodnot\u011b vy\u017eadovat zaplacen\u00ed odli\u0161n\u00fdch \u010d\u00e1stek dan\u011b, a to i p\u0159esto, \u017ee z\u00e1kladn\u00ed principy v\u00fdpo\u010dtu jsou v cel\u00e9 zemi stejn\u00e9. Chcete-li Plusval\u00eda Municipal p\u0159esn\u011b vypo\u010d\u00edtat u\u017e ve f\u00e1zi pl\u00e1nov\u00e1n\u00ed transakce, m\u016f\u017eete vyu\u017e\u00edt kalkula\u010dku na webu radnice obce, kde se nemovitost nach\u00e1z\u00ed, nebo se obr\u00e1tit na da\u0148ov\u00e9ho poradce, gestora \u010di realitn\u00edho makl\u00e9\u0159e, kter\u00fd koupi a prodej zaji\u0161\u0165uje.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Da\u0148ov\u00e1 reforma z roku 2021 schv\u00e1lila dv\u011b metody v\u00fdpo\u010dtu dan\u011b a ponechala prod\u00e1vaj\u00edc\u00edmu pr\u00e1vo zvolit si tu v\u00fdhodn\u011bj\u0161\u00ed podle vlastn\u00edho uv\u00e1\u017een\u00ed: metodu p\u0159\u00edm\u00e9ho\/skute\u010dn\u00e9ho odhadu (<em>M\u00e9todo de estimaci\u00f3n directa\/real<\/em>) nebo metodu objektivn\u00edho odhadu (<em>M\u00e9todo de estimaci\u00f3n objetiva<\/em>). Ve v\u00fdchoz\u00edm nastaven\u00ed se pou\u017e\u00edv\u00e1 druh\u00e1 metoda \u2013 objektivn\u00ed. Da\u0148 Plusval\u00eda Municipal se vztahuje na zv\u00fd\u0161en\u00ed hodnoty pozemku, na n\u011bm\u017e se nemovitost nach\u00e1z\u00ed. V okam\u017eiku koup\u011b bytu nebo komer\u010dn\u00edho prostoru m\u011bl pozemek ur\u010ditou hodnotu. P\u0159edpokl\u00e1d\u00e1 se, \u017ee do okam\u017eiku prodeje se zlep\u0161ila okoln\u00ed infrastruktura, do\u0161lo k obecn\u00e9mu r\u016fstu cen a inflaci, a tedy i ke zv\u00fd\u0161en\u00ed hodnoty pozemku. Pr\u00e1v\u011b toto \u201ezdra\u017een\u00ed\u201c se obce sna\u017e\u00ed zdanit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Povinnost uhradit Plusval\u00eda Municipal nevznik\u00e1 pouze p\u0159i prodeji nemovitosti ve \u0160pan\u011blsku, ale tak\u00e9 p\u0159i nabyt\u00ed nemovitosti d\u011bdictv\u00edm nebo darem.<\/span><\/p>\n<h2><b>Metody v\u00fdpo\u010dtu Plusval\u00eda Municipal v roce 2026<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Metoda objektivn\u00edho odhadu nezohled\u0148uje skute\u010dn\u00fd zisk, ale \u0159\u00edd\u00ed se dobou vlastnictv\u00ed nemovitosti:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Jak se vypo\u010d\u00edt\u00e1v\u00e1: vych\u00e1z\u00ed se z <\/span><a href=\"https:\/\/alegria-realestate.com\/cs\/articles\/cadastral-value-of-real-estate-in-spain\"><span style=\"font-weight: 400;\">katastr\u00e1ln\u00ed hodnoty pozemku<\/span><\/a><span style=\"font-weight: 400;\"> (je uvedena na potvrzen\u00ed o zaplacen\u00ed dan\u011b z nemovitosti <\/span><a href=\"https:\/\/alegria-realestate.com\/cs\/articles\/ibi-tax-in-spain\"><span style=\"font-weight: 400;\">IBI<\/span><\/a><span style=\"font-weight: 400;\">), na kterou se pou\u017eije koeficient z\u00e1visl\u00fd na po\u010dtu let vlastnictv\u00ed nemovitosti, a na v\u00fdslednou \u010d\u00e1stku se n\u00e1sledn\u011b aplikuje platn\u00e1 procentn\u00ed sazba.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pro koho je v\u00fdhodn\u00e1: zpravidla pro ty, kdo prod\u00e1vaj\u00ed nemovitost, kter\u00e1 v\u00fdrazn\u011b vzrostla ve skute\u010dn\u00e9 tr\u017en\u00ed cen\u011b, ale jej\u00ed katastr\u00e1ln\u00ed hodnota z\u016fstala relativn\u011b stabiln\u00ed. Jde o \u201ematematickou\u201c metodu, kter\u00e1 nezohled\u0148uje v\u00fdkyvy trhu s nemovitostmi.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Koeficienty a sazby se stanovuj\u00ed na \u00farovni obc\u00ed. Na st\u00e1tn\u00ed \u00farovni jsou ur\u010deny maxim\u00e1ln\u00ed hodnoty, kter\u00e9 obce nesm\u011bj\u00ed p\u0159ekro\u010dit. V roce 2026 vl\u00e1da p\u0159i\u0161la s iniciativou zv\u00fd\u0161it koeficienty (s c\u00edlem \u201epotrestat\u201c spekulativn\u00ed transakce, zejm\u00e9na b\u011bhem prvn\u00edch 15 let vlastnictv\u00ed), ale n\u00e1vrh z\u00e1kona nepro\u0161el schvalovac\u00edm \u0159\u00edzen\u00edm a maxim\u00e1ln\u00ed koeficienty z\u016fstaly na \u00farovni roku 2024.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Metoda skute\u010dn\u00e9ho odhadu je zalo\u017eena na re\u00e1ln\u00e9m zisku z prodeje nemovitosti ve \u0160pan\u011blsku:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Jak se vypo\u010d\u00edt\u00e1v\u00e1: od prodejn\u00ed ceny se ode\u010dte kupn\u00ed cena. Na z\u00edskan\u00fd rozd\u00edl se pou\u017eije procento, kter\u00e9 odr\u00e1\u017e\u00ed pod\u00edl hodnoty pozemku na celkov\u00e9 katastr\u00e1ln\u00ed hodnot\u011b nemovitosti (tento pod\u00edl lze vypo\u010d\u00edtat z \u00fadaj\u016f uveden\u00fdch na potvrzen\u00ed o zaplacen\u00ed dan\u011b z nemovitosti IBI), a na v\u00fdslednou \u010d\u00e1stku se n\u00e1sledn\u011b aplikuje procentn\u00ed sazba platn\u00e1 v dan\u00e9 obci.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pro koho je v\u00fdhodn\u00e1: pro ty, kdo prod\u00e1vaj\u00ed nemovitost kr\u00e1tce po koupi nebo v podm\u00ednk\u00e1ch trhu s minim\u00e1ln\u00edm r\u016fstem cen. Podle posledn\u00edho potvrzen\u00ed o zaplacen\u00ed dan\u011b z nemovitosti IBI \u010din\u00ed katastr\u00e1ln\u00ed hodnota nemovitosti 55.000 \u20ac, z toho: 15.000 \u20ac je katastr\u00e1ln\u00ed hodnota pozemku a 40.000 \u20ac je katastr\u00e1ln\u00ed hodnota stavby.<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">Plusval\u00eda Municipal k \u00fahrad\u011b: 405,00 \u20ac podle metody objektivn\u00edho odhadu a 7.853,76 \u20ac podle metody skute\u010dn\u00e9ho odhadu.<\/span><\/i><\/p>\n<p><b>P\u0159\u00edklad 2.<\/b> <i><span style=\"font-weight: 400;\">Zad\u00e1n\u00ed: v \u010dervenci 2005 byl v Benidormu koupen bungalov za 155.000 \u20ac, v b\u0159eznu 2026 byl prod\u00e1n za 160.000 \u20ac. Podle posledn\u00edho potvrzen\u00ed o zaplacen\u00ed dan\u011b z nemovitosti IBI \u010din\u00ed katastr\u00e1ln\u00ed hodnota nemovitosti 55.000 \u20ac, z toho: 15.000 \u20ac je katastr\u00e1ln\u00ed hodnota pozemku a 40.000 \u20ac je katastr\u00e1ln\u00ed hodnota stavby.<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">Plusval\u00eda Municipal k \u00fahrad\u011b: 1.800,00 \u20ac podle metody objektivn\u00edho odhadu a 409,05 \u20ac podle metody skute\u010dn\u00e9ho odhadu.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Jak jsme uvedli v\u00fd\u0161e, metoda objektivn\u00edho odhadu se pou\u017eije automaticky. Pro pou\u017eit\u00ed metody skute\u010dn\u00e9ho odhadu je nutn\u00e9:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">p\u0159edlo\u017eit not\u00e1\u0159i, kter\u00fd transakci ov\u011b\u0159uje, p\u016fvodn\u00ed kupn\u00ed smlouvu, ve kter\u00e9 je uvedena kupn\u00ed cena (v p\u0159\u00edpad\u011b nabyt\u00ed nemovitosti darem nebo d\u011bdictv\u00edm p\u0159\u00edslu\u0161n\u00fd not\u00e1\u0159sk\u00fd akt);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">v okam\u017eiku podpisu transakce p\u0159ilo\u017eit k dokument\u016fm p\u00edsemn\u00e9 prohl\u00e1\u0161en\u00ed o z\u00e1m\u011bru pou\u017e\u00edt metodu skute\u010dn\u00e9ho odhadu na z\u00e1klad\u011b dosa\u017een\u00e9ho zisku.<\/span><\/li>\n<\/ul>\n<h2><b>Kdo je povinen platit Plusval\u00eda Municipal ve \u0160pan\u011blsku?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Da\u0148 Plusval\u00eda Municipal hrad\u00ed prod\u00e1vaj\u00edc\u00ed nemovitosti. Povinnosti t\u00fdkaj\u00edc\u00ed se sra\u017een\u00ed, p\u0159izn\u00e1n\u00ed a odveden\u00ed \u010d\u00e1stky do rozpo\u010dtu v\u0161ak mohou b\u00fdt rozd\u011bleny n\u00e1sledovn\u011b:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">na samotn\u00e9ho prod\u00e1vaj\u00edc\u00edho, pokud je da\u0148ov\u00fdm rezidentem \u0160pan\u011blska;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">na kupuj\u00edc\u00edho, pokud prod\u00e1vaj\u00edc\u00ed nen\u00ed da\u0148ov\u00fdm rezidentem \u0160pan\u011blska. V takov\u00e9m p\u0159\u00edpad\u011b pot\u0159ebnou \u010d\u00e1stku zadr\u017e\u00ed kupuj\u00edc\u00ed prod\u00e1vaj\u00edc\u00edmu p\u0159i seps\u00e1n\u00ed kupn\u00ed smlouvy a vyrovn\u00e1n\u00ed transakce v p\u0159\u00edtomnosti not\u00e1\u0159e. To znamen\u00e1, \u017ee poplatn\u00edkem z\u016fst\u00e1v\u00e1 i nad\u00e1le prod\u00e1vaj\u00edc\u00ed, ale administrativn\u00ed postup p\u0159izn\u00e1n\u00ed a odveden\u00ed zadr\u017een\u00e9 \u010d\u00e1stky je povinnost\u00ed kupuj\u00edc\u00edho.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Na zaplacen\u00ed dan\u011b je 30 pracovn\u00edch dn\u016f od podpisu transakce u not\u00e1\u0159e. Je d\u016fle\u017eit\u00e9 lh\u016ftu neprome\u0161kat, proto\u017ee pokuty za prodlen\u00ed mohou \u010dinit od 5 % do 20 %. Obce \u010dasto schvaluj\u00ed da\u0148ov\u00e9 \u00falevy p\u0159i transakc\u00edch t\u00fdkaj\u00edc\u00edch se hlavn\u00edho bydli\u0161t\u011b nebo v p\u0159\u00edpad\u011b d\u011bdictv\u00ed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pokud je nemovitost ve \u0160pan\u011blsku prod\u00e1na bez zisku nebo se ztr\u00e1tou, povinnost uhradit Plusval\u00eda Municipal nevznik\u00e1, proto\u017ee metoda skute\u010dn\u00e9ho odhadu d\u00e1 z\u00e1porn\u00fd v\u00fdsledek.
