Any individual who is a tax resident of Spain and earns income above the legal threshold for the calendar year is required to declare it and pay personal income tax (IRPF). IRPF is a tax levied on the income of individuals living in Spain and earned from employment and capital during one reporting period, that is, the calendar year. Therefore, income tax is not limited to employment or self-employment income, but also applies to income from real estate, for example from renting out property, income from movable capital such as dividends, bank deposits and accounts, as well as capital gains or losses from the sale of shares, real estate, NFTs, and so on, all of which must be included in the annual tax return.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, in some cases the legislation itself assumes the existence of income in the relevant tax period and includes it in taxation. This is known as imputed income. For example, a second home and any additional homes may be taxed at 2% of the cadastral value even if they are not rented out and do not generate any actual income.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Income tax in Spain is a progressive tax: the higher the income, the higher the tax rate applied to the taxable base. Like taxes such as IVTM (vehicle tax) or IBI (property tax), IRPF is a direct tax because it directly taxes the income or assets of taxpayers. Income tax applies throughout the country, although each autonomous community may establish its own specific tax deductions and relief. Tax rates also vary by region, since they consist of two separate rates, one set at state level and the other at the autonomous community level. Any tax resident receiving annual income above the SMI (minimum wage set in 2026 at \u20ac17,094) is required to pay income tax, the rate of which increases in line with the taxpayer\u2019s economic capacity.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Spanish tax authorities recognise tax residency if one of the following conditions is met:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\">Presence in Spain for more than 183 days during the calendar year. All entries and exits are taken into account, including short trips. Cases are excluded where the individual can prove tax residency in another country.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Having their centre of economic interests or main source of income in Spain. An individual will be regarded as a tax resident of Spain if their main economic interests, business activity, or primary source of income is located here. Economic ties may be either direct or indirect.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">In addition, current legislation establishes a presumption of tax residency in Spain, unless proven otherwise, where the person\u2019s lawful spouse and dependent minor children permanently reside in the country and the person falls under one of the criteria above.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Individuals who have certain economic relations with the Spanish state but are not tax residents are subject to another tax \u2013 <a href=\"https:\/\/alegria-realestate.com\/en\/articles\/non-residents-property-taxes-in-spain\">non-resident income tax<\/a> (Impuesto sobre la Renta de No Residentes \u2013 IRNR). Economic relations may include, for example, a non-resident purchasing property in Spain. Even if the property is not rented out and is used exclusively for personal residence, Spanish law imputes income solely on the basis of ownership. Another example is a non-resident who opens a business in Spain, appoints a manager, does not work there personally, but is entitled to dividends at year-end. Those dividends are subject to IRNR. Bank deposits, securities investments, and the sale of real estate at a profit should also be taken into account \u2013 all these economic transactions trigger tax obligations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Different rules apply to the assessment and payment of non-resident income tax, as well as to filing deadlines and filing methods. Therefore, the employer is responsible for remitting the withheld income tax to the tax authorities for each employee.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Self-employed professionals engaged in professional activity pay tax through advance instalments during the year before filing the annual income tax return. The withheld tax is shown on each invoice if the client is another company or self-employed person and the transaction takes place in Spain. In this case, the IRPF withholding is shown as a separate line on the invoice, and the counterparty acts as the withholding agent responsible for paying the withheld amount into the budget. However, because income is variable and received from different clients, the withholding percentage must be applied depending on the type of activity carried out. In most cases, the withholding rate is 15%, except for some professions or the first three years of activity, when it is 7%. Special attention should be paid to farmers, livestock breeders, and forestry professionals, since for them the withholding rate is only 2%.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If a self-employed person works with private individuals, that is, no tax withholding is made on invoices, then they are personally responsible for declaring and paying personal income tax. In this case, IRPF returns are filed quarterly, and the final settlement is made when the annual tax return is submitted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After filing the annual tax return, which takes place every year from April to June, and after applying individual and family deductions, if the withheld amount exceeds the tax actually due, the taxpayer is entitled to a refund from the budget.
