The negotiations went well, you managed to knock \u20ac5,000 off the asking price, and you are already planning where to put the furniture. Then the notary&#8217;s estimate arrives, complete with an additional charge of \u20ac15,000\u2013\u20ac20,000 that you had not budgeted for.<\/p>\n<p>Meet ITP, Spain&#8217;s property transfer tax. It can be one of the largest additional costs when buying a resale property. The good news is that it should not come as a surprise: the applicable rules can be checked well before you sign.<\/p>\n<p>Here is how the tax works, who must pay it, what rates apply across Spain in 2026 and when a reduced rate might be available.<\/p>\n<h2 id=\"what-is-itp\">What is ITP and how does it differ from VAT?<\/h2>\n<p>ITP stands for <em>Impuesto sobre Transmisiones Patrimoniales<\/em>. In property transactions, it usually refers to the tax on transfers for consideration, known as <em>Transmisiones Patrimoniales Onerosas<\/em> or TPO. It most commonly applies when buying an existing home from a private owner.<\/p>\n<p>As a general rule, the first sale of a newly built home by a developer is subject to Spanish VAT, or IVA. A later sale that is exempt from IVA will usually fall under ITP instead. The seller&#8217;s identity alone does not decide the tax treatment: a company can sell a resale property subject to ITP, while certain transactions between businesses may be subject to IVA if the legal requirements are met.<\/p>\n<p>The financial difference can be substantial. A new home bought from a developer generally attracts 10% IVA plus stamp duty, AJD, which often ranges from 0.5% to 1.5% depending on the region. If that same home is subsequently sold by a private owner, ITP will normally apply instead. Depending on the location and circumstances, ITP can be lower or higher than the combined IVA and AJD payable on a new-build purchase.<\/p>\n<p>That is why resale property is not automatically the cheaper option once taxes have been added to the price. When calculating ITP on property, the authorities generally compare three figures: the reference value established by the Catastro (<em>valor de referencia<\/em>), the declared property value and the purchase price. The highest of those values is normally used as the taxable base.<\/p>\n<p>If the Catastro reference value exceeds the price you negotiated, your ITP calculation may therefore be based on the higher figure. If the agreed price is higher, that price takes precedence. Where no reference value exists or it cannot be certified, separate valuation rules apply.<\/p>\n<p>A successful price negotiation does not necessarily produce an equivalent saving on ITP. However, the reference value can be challenged through the appropriate legal procedure where there are grounds to do so.<\/p>\n<h2 id=\"who-pays-itp\">Who pays ITP and when?<\/h2>\n<p><strong>The buyer is the taxpayer.<\/strong> A private agreement with the seller may regulate how the parties settle expenses between themselves, but it does not change who is legally liable for ITP.<\/p>\n<p>The payment deadline depends on the regional rules. The general ITP regulations refer to 30 working days following the taxable transaction, but some autonomous communities have their own procedures. In Catalonia, for example, the usual deadline for property purchases is one month. Do not assume that the same deadline applies everywhere in Spain.<\/p>\n<p>The return is normally filed using <strong>Modelo 600<\/strong> with the tax authority of the autonomous community where the property is located. The buyer&#8217;s own address or place of residence does not determine which regional rate applies. A home in Alicante is taxed under Valencian rules, even if its purchaser lives elsewhere.<\/p>\n<p>Depending on the regional procedure, filing may be possible in person, through a gestor or lawyer, or online using an accepted electronic certificate. Autonomous communities have powers to set ITP rates and introduce certain reliefs, while the Basque Country and Navarra operate under their own special tax regimes. As a result, the tax bill on a \u20ac200,000 home can vary considerably depending on its location.<\/p>\n<p>As at 9 October 2026, the main rates for standard transactions can be grouped as follows. Individual cases may depend on the price, province or buyer&#8217;s circumstances.<\/p>\n<p><strong>Lower general rates:<\/strong><\/p>\n<ul>\n<li><strong>Basque Country:<\/strong> 4% in a number of cases. Its historical foral tax regime allows the relevant territories to apply their own rules and sometimes lower rates for eligible homes and purchasers.<\/li>\n<li><strong>Madrid and Navarra:<\/strong> 6% general rate.<\/li>\n<li><strong>Canary Islands:<\/strong> 6.5% general rate.<\/li>\n<\/ul>\n<p><strong>Middle range:<\/strong><\/p>\n<ul>\n<li><strong>Andalusia and La Rioja:<\/strong> 7%.<\/li>\n<li><strong>Murcia:<\/strong> 7.75%, following changes introduced in summer 2025.<\/li>\n<li><strong>Aragon:<\/strong> progressive rates starting at 8%, with higher bands for more expensive properties.<\/li>\n<li><strong>Galicia:<\/strong> 8% general rate.<\/li>\n<li><strong>Castile and Le\u00f3n:<\/strong> 8% general rate, with higher rates applying to the relevant portion of certain high-value purchases.<\/li>\n<li><strong>Cantabria and Castile-La Mancha:<\/strong> 9% general rate, subject to regional rules.<\/li>\n<li><strong>Valencian Community:<\/strong> 9% since 1 June 2026, reduced from 10%. A special 20% rate applies to certain purchases by large residential property holders and certain acquisitions of entire residential buildings.<\/li>\n<li><strong>Balearic Islands:<\/strong> a progressive scale ranging from 8% to 13%.<\/li>\n<\/ul>\n<p>To illustrate the difference, 4% on a \u20ac200,000 property amounts to \u20ac8,000, while 10% on the same value amounts to \u20ac20,000. That \u20ac12,000 gap is worth considering before signing a reservation agreement.<\/p>\n<p>On the Costa Blanca, Valencian rates are particularly relevant. The reduction from 10% to 9% in June 2026 has lowered the standard bill, although properties exceeding \u20ac1 million remain subject to the separate 11% rate. The details vary, and an eligible buyer may save a meaningful amount by checking the rules before completing the purchase.<\/p>\n<ul>\n<li><strong>Younger buyers.<\/strong> Certain regions offer reduced ITP for people buying their first main residence, subject to age, income and property-value conditions. In the Valencian Community, eligible buyers under 35 may qualify for 6% where the value does not exceed \u20ac180,000, or 8% above that threshold. The reduction applies to the qualifying share acquired and is subject to income-related requirements. Andalusia provides a 3.5% rate for qualifying purchasers under 35 buying a main home worth no more than \u20ac150,000. In Catalonia, the relevant age limit was raised in June 2025 to include buyers aged 35, and the qualifying rate is 5%.<\/li>\n<li><strong>Large families and eligible single-parent families.<\/strong> Special rates are available in several regions. In the Valencian Community, eligible family categories may qualify for 3% or 4%, depending on the property value and other conditions. Andalusia also offers a 3.5% rate in qualifying family situations, subject to limits and statutory requirements.<\/li>\n<li><strong>Buyers with officially recognised disabilities.<\/strong> Spanish legislation uses a certified disability percentage, known as <em>grado de discapacidad<\/em>, rather than informal categories of reduced work capacity. Thresholds of 33% and 65% frequently appear in the rules, but eligibility depends on the specific region, type of disability, intended use of the home and other legal conditions.<\/li>\n<\/ul>\n<p>For example, eligible buyers with a recognised disability may qualify for a 3% rate in the Valencian Community on a main residence worth up to \u20ac180,000, provided the statutory requirements are met. Other reduced rates can apply in certain higher-value cases. Cantabria also offers specific relief, and the Balearic Islands provide substantial reductions for particular purchasers. Full exemption should never be assumed without checking the exact legal basis.<\/p>\n<p>Some rural and sparsely populated areas offer especially favourable treatment. Under certain conditions, regional ITP rates can be as low as 3%\u20134% in designated locations. Catalonia, for example, provides special rules for qualifying purchases of main homes in certain rural municipalities.<\/p>\n<p>These benefits are not necessarily applied automatically. Buyers typically need to claim the correct rate in their return and retain evidence of eligibility, which may cover age, income, family status, disability, property value and use as a main residence.<\/p>\n<p>If a benefit was overlooked, correcting the tax return and requesting a refund may sometimes be possible, depending on deadlines and local procedures. It is generally easier to check the position before submitting Modelo 600.<\/p>\n<h2 id=\"itp-calculation\">How to calculate ITP: Practical examples<\/h2>\n<p>Consider a resale villa in the province of Alicante purchased for \u20ac350,000 after 1 June 2026. Assume that the taxable value is the same as the purchase price. At the Valencian standard rate of 9%, the tax is <strong>\u20ac31,500<\/strong>.<\/p>\n<p>If an eligible buyer under 35 purchases the same property as their first main residence and meets the income and other requirements, the 8% reduced rate may apply because the price exceeds \u20ac180,000. On the entire property value, that would mean <strong>\u20ac28,000<\/strong>, saving \u20ac3,500.<\/p>\n<p>For joint purchasers, eligibility and the calculation must also reflect each buyer&#8217;s ownership share and individual circumstances.<\/p>\n<p>At a purchase price of \u20ac170,000, a qualifying buyer eligible for 6% would pay <strong>\u20ac10,200<\/strong> rather than the standard \u20ac15,300. The difference is \u20ac5,100, assuming the taxable value is also \u20ac170,000.<\/p>\n<p>For comparison, a \u20ac350,000 property in Madrid would attract \u20ac21,000 at the standard 6% rate. Reduced rates apply only when all eligibility conditions have been met.<\/small><\/p>\n<h2 id=\"itp-common-mistakes\">What buyers often overlook<\/h2>\n<p>A common shortcut is to add roughly 10% to the asking price and assume that will cover everything. That can be misleading. Alongside ITP, buyers may need to budget for the notary, Land Registry, legal advice and, where mortgage finance is involved, the property valuation.<\/p>\n<p>Mortgage-related expenses are allocated between lender and borrower under the applicable law, so it would be incorrect to assume that every banking or mortgage deed cost falls on the buyer.<\/p>\n<p>In regions with high ITP, total additional costs on a resale purchase can reach 12%\u201314% of the property price and sometimes more. A property-specific calculation is therefore far more useful than a single nationwide estimate.<\/p>\n<p>Another mistake is assuming that understating the purchase price in the contract will automatically reduce tax. The reference-value rules can prevent that outcome, and inaccurate declarations may result in investigations or additional assessments.<\/p>\n<p>An artificially understated acquisition value may also create problems when the property is sold later. If the accepted acquisition value is too low, the capital gain calculated on resale may be higher. The rules for ITP and capital gains tax are not identical, however, so the relevant values must be assessed separately.<\/p>\n<p>Finally, buyers sometimes confuse ITP on property with transfer taxes on vehicles or other assets. These may involve different rates and rules, so they should not be used as a guide to a residential purchase.<\/p>\n<h2 id=\"before-property-purchase\">What to check before buying a home<\/h2>\n<p>Before paying a deposit, establish three things: the current ITP rate where the property is located, whether you qualify for any relief, and whether the agreed price corresponds to the taxable value, including any Catastro reference value.<\/p>\n<p>An experienced property lawyer or a well-informed agency can help you confirm these points rather than relying on headline rates quoted for Spain as a whole.<\/p>\n<p>Tax rules change, and a transaction can take several months to complete.
