{"id":584301,"date":"2025-09-01T14:53:24","date_gmt":"2025-09-01T11:53:24","guid":{"rendered":"https:\/\/alegria-realestate.com\/?p=584301"},"modified":"2025-10-13T18:57:07","modified_gmt":"2025-10-13T15:57:07","slug":"tourist-license-in-spain-everything-you-need-to-know","status":"publish","type":"post","link":"https:\/\/alegria-realestate.com\/fr\/articles\/tourist-license-in-spain-everything-you-need-to-know","title":{"rendered":"Comment obtenir une licence touristique de location en Espagne en 2025"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">En 2025, l\u2019Espagne a introduit de nouvelles r\u00e8gles relatives \u00e0 la location touristique, motiv\u00e9es par la popularit\u00e9 croissante des plateformes num\u00e9riques et la volont\u00e9 de l\u2019\u00c9tat d\u2019unifier et de contr\u00f4ler ce secteur.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Depuis le 1<sup>er<\/sup> juillet 2025, le Registre num\u00e9rique unique de la location fonctionne en Espagne \u2013 un syst\u00e8me de collecte et d\u2019\u00e9change de donn\u00e9es centralis\u00e9. L\u2019une des principales nouveaut\u00e9s est l\u2019inscription obligatoire au Registre de tous les biens propos\u00e9s \u00e0 la <a href=\"https:\/\/alegria-realestate.com\/fr\/service\/rent-out-property-in-spain\">location touristique ou saisonni\u00e8re<\/a>. Le Registre garantit l\u2019identification correcte des biens et facilite le contr\u00f4le des autorit\u00e9s locales et nationales.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les plateformes (Booking, Tripadvisor, Expedia, Airbnb, Vrbo\/HomeAway) doivent \u00e9changer p\u00e9riodiquement des donn\u00e9es avec le Registre afin d\u2019assurer le respect de la loi et de d\u00e9tecter les infractions. Concr\u00e8tement, seules les annonces de biens disposant d\u2019un num\u00e9ro NRU (N\u00famero de Registro \u00danico) peuvent \u00eatre publi\u00e9es, m\u00eame si une licence touristique est en vigueur.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Distinguons deux types de location de courte dur\u00e9e : la location saisonni\u00e8re et la location touristique.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Location saisonni\u00e8re<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Les \u00ab Viviendas de uso temporal \u00bb sont des logements non destin\u00e9s \u00e0 la r\u00e9sidence permanente, r\u00e9pondant \u00e0 des besoins temporaires (\u00e9tudiants, travailleurs saisonniers, personnes en traitement, etc.) pour une dur\u00e9e de 31 jours \u00e0 9 mois.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dans ces cas, aucun permis suppl\u00e9mentaire ni information additionnelle ne sont requis par les autorit\u00e9s r\u00e9gionales ou municipales. Ces biens rel\u00e8vent de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1994-26003\">Loi 29\/1994 du 24 novembre sur les baux urbains<\/a>.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Location touristique<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Les \u00ab Viviendas de uso tur\u00edstico \u00bb sont des logements pour des s\u00e9jours touristiques jusqu\u2019\u00e0 30 jours, r\u00e9gis par des r\u00e8gles sp\u00e9cifiques des communaut\u00e9s autonomes ou des municipalit\u00e9s, responsables du contr\u00f4le et habilit\u00e9es \u00e0 fixer leurs propres exigences.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Attention : dans la Communaut\u00e9 valencienne, est consid\u00e9r\u00e9e comme touristique toute location jusqu\u2019\u00e0 10 jours (nuits) cons\u00e9cutifs au m\u00eame locataire ; une fois enregistr\u00e9e comme logement touristique, aucun autre type de contrat n\u2019est admis.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Viviendas de uso temporal : obtention du NRU<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Pour enregistrer un logement destin\u00e9 \u00e0 la location saisonni\u00e8re, il faut :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\">Num\u00e9ro cadastral et adresse exacte du bien.<\/li>\n<li style=\"font-weight: 400;\">Pr\u00e9ciser si la location concerne le logement entier ou des chambres.<\/li>\n<li style=\"font-weight: 400;\">Indiquer la capacit\u00e9 maximale.<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Le num\u00e9ro NRU s\u2019obtient via le site du Coll\u00e8ge des registraires (<\/span><a href=\"https:\/\/sede.registradores.org\/sede\/sede-corpme-web\/home\"><span style=\"font-weight: 400;\">Colegio de Registradores<\/span><\/a><span style=\"font-weight: 400;\">) avec certificat \u00e9lectronique. Un NRU provisoire est attribu\u00e9 imm\u00e9diatement, puis devient d\u00e9finitif apr\u00e8s v\u00e9rification. Ce num\u00e9ro doit figurer sur toutes les plateformes o\u00f9 la location saisonni\u00e8re est publi\u00e9e.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Viviendas de uso tur\u00edstico : obtention du NRU<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Pour un logement destin\u00e9 \u00e0 la location touristique, il faut :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\">Num\u00e9ro cadastral et adresse pr\u00e9cise.<\/li>\n<li style=\"font-weight: 400;\">Indiquer si la location se fait en entier ou par chambres (interdit dans certaines r\u00e9gions).<\/li>\n<li style=\"font-weight: 400;\">Indiquer la capacit\u00e9 maximale.<\/li>\n<li style=\"font-weight: 400;\">Respecter la r\u00e9glementation locale : les proc\u00e9dures exig\u00e9es par la communaut\u00e9 autonome doivent \u00eatre accomplies au pr\u00e9alable.<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">La demande de NRU se fait via le <a href=\"https:\/\/sede.registradores.org\/sede\/sede-corpme-web\/home\">Colegio de Registradores<\/a> avec certificat \u00e9lectronique. Le num\u00e9ro provisoire devient d\u00e9finitif apr\u00e8s contr\u00f4le. Il doit appara\u00eetre dans toutes les annonces de location touristique.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Pouvoirs de la communaut\u00e9 de propri\u00e9taires<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Depuis avril 2025, toute nouvelle activit\u00e9 de location saisonni\u00e8re ou touristique doit \u00eatre approuv\u00e9e par au moins 60 % des copropri\u00e9taires en assembl\u00e9e. Toute d\u00e9cision (autoriser, limiter, interdire) requiert la majorit\u00e9 des 3\/5 (60 %) des voix et quotes-parts.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019assembl\u00e9e peut approuver une majoration de la quote-part jusqu\u2019\u00e0 20 % pour les logements d\u00e9di\u00e9s \u00e0 la location saisonni\u00e8re ou touristique.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Par d\u00e9faut, la location de courte dur\u00e9e est interdite jusqu\u2019\u00e0 autorisation par la communaut\u00e9. Les licences touristiques d\u00e9livr\u00e9es avant le 3 avril 2025 restent valables (pas d\u2019effet r\u00e9troactif). Certaines municipalit\u00e9s (notamment Barcelone) ont toutefois annonc\u00e9 ne pas renouveler les licences arrivant \u00e0 expiration. Il faut suivre les changements locaux pour \u00e9viter les sanctions.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Location touristique de courte dur\u00e9e et TVA<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">\u00c0 compter du 1<sup>er<\/sup> juillet 2028, la <a href=\"https:\/\/alegria-realestate.com\/fr\/articles\/all-about-vat-in-spain\">TVA<\/a> deviendra obligatoire pour toutes les locations touristiques de courte dur\u00e9e (s\u00e9jours \u2264 30 jours), m\u00eame sans services h\u00f4teliers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pour les bailleurs : inscription comme travailleur ind\u00e9pendant (aut\u00f3nomo) pour d\u00e9clarer la TVA et \u00e9mettre des factures\u2009; tenue des livres et conservation des documents au moins 4 ans.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le taux attendu est de 10 %, par analogie avec d\u2019autres services touristiques.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Licence touristique en Espagne<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Outre le NRU, les logements touristiques n\u00e9cessitent une licence conform\u00e9ment aux r\u00e8gles de la r\u00e9gion d\u2019implantation. Les lois locales varient fortement et \u00e9voluent : il faut v\u00e9rifier l\u2019information \u00e0 jour.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Exigences communes : inscription au registre du tourisme\u2009; normes techniques\/s\u00e9curit\u00e9\/habitabilit\u00e9\u2009; \u00e9quipement minimum\u2009; services (eau, \u00e9lectricit\u00e9, Internet)\u2009; assurance RC\u2009; plaque d\u2019identification (selon la r\u00e9gion)\u2009; registre des voyageurs et livre de r\u00e9clamations\u2009; information claire sur les prix et conditions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dossier de base : d\u00e9claration responsable\u2009; copie du DNI\/NIE\u2009; titre de propri\u00e9t\u00e9 ou droit d\u2019usage (acte, <a href=\"https:\/\/alegria-realestate.com\/fr\/articles\/all-about-nota-simple-in-spain\">nota simple<\/a>, bail autorisant la sous-location, etc.)\u2009; certificat d\u2019habitabilit\u00e9 ou licence de premi\u00e8re occupation\u2009; plan\u2009; assurance RC\u2009; justificatif de paiement des frais\u2009; <a href=\"https:\/\/alegria-realestate.com\/fr\/articles\/how-to-check-a-property-when-buying-in-spain\">certificat d\u2019efficacit\u00e9 \u00e9nerg\u00e9tique<\/a>\u2009; autorisation de la communaut\u00e9.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Amendes en cas d\u2019absence de licence touristique et de NRU<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">En 2025, le contr\u00f4le s\u2019est intensifi\u00e9, avec des amendes plus \u00e9lev\u00e9es. \u00c9tat : absence de NRU \u2013 2\u2009000 \u00e0 500\u2009000 \u20ac\u2009; annonces sans NRU \u2013 jusqu\u2019\u00e0 300\u2009000 \u20ac. R\u00e9gions : Catalogne \u2013 9\u2009000 \u00e0 90\u2009000 \u20ac\u2009; \u00celes Bal\u00e9ares \u2013 jusqu\u2019\u00e0 400\u2009000 \u20ac\u2009; Andalousie et Communaut\u00e9 valencienne \u2013
