Les pr\u00eats hypoth\u00e9caires en Espagne pour les Russes et les autres citoyens \u00e9trangers sont accord\u00e9s aux m\u00eames conditions que pour les citoyens espagnols. Le 17 juin 2019, une nouvelle loi hypoth\u00e9caire est entr\u00e9e en vigueur en Espagne, appel\u00e9e Ley de Cr\u00e9dito Inmobiliario 5\/2019. Son adoption a tra\u00een\u00e9 pendant plus de trois ans : l&#39;\u00e9laboration de la loi au minist\u00e8re espagnol de l&#39;\u00c9conomie a commenc\u00e9 en 2017 sous la pression de Bruxelles. Quelle est cette loi et comment affectera-t-elle l&#39;\u00e9mission d&#39;hypoth\u00e8ques en Espagne ? Essayons de comprendre. Selon les exigences de Bruxelles, au printemps 2016, tous les \u00c9tats membres de l&#39;UE devaient \u00e9laborer une l\u00e9gislation comprenant des principes communs \u00e0 l&#39;ensemble de l&#39;Union europ\u00e9enne dans le domaine des hypoth\u00e8ques, cependant, en raison de la situation politique instable, les d\u00e9lais n&#39;ont pas pu \u00eatre rencontr\u00e9. Le texte final de la nouvelle loi hypoth\u00e9caire espagnole contient non seulement les points qui devaient y figurer conform\u00e9ment \u00e0 la directive de Bruxelles, mais \u00e9galement un certain nombre d&#39;innovations introduites par le gouvernement espagnol de sa propre initiative et destin\u00e9es \u00e0 accro\u00eetre la s\u00e9curit\u00e9 et transparence des transactions hypoth\u00e9caires pour les banques et leurs clients. Ci-dessous, nous passerons en revue les principaux changements qui sont entr\u00e9s en vigueur avec la nouvelle loi.<\/p>\n<ul>\n<li> Le client est tenu de s&#39;adresser au notaire au moins 10 jours avant la conclusion du contrat hypoth\u00e9caire afin de r\u00e9soudre tous ses doutes. La banque, \u00e0 son tour, doit fournir au client un accord avec des conditions soigneusement prescrites au moins 10 jours avant la signature. Le service est gratuit pour le client. Suite \u00e0 la rencontre avec le notaire, le client confirme que tous les termes du contrat sont clairs pour lui, et qu&#39;il les accepte en signant un document sp\u00e9cial.<\/li>\n<li> Limitation de la commission en cas de remboursement anticip\u00e9 partiel ou total d&#39;un cr\u00e9dit immobilier. Des restrictions sont fix\u00e9es en fonction du type d&#39;hypoth\u00e8que (avec un taux d&#39;int\u00e9r\u00eat fixe ou diff\u00e9renci\u00e9), ainsi qu&#39;en fonction de la p\u00e9riode \u00e0 laquelle le remboursement a \u00e9t\u00e9 effectu\u00e9 (dans la premi\u00e8re moiti\u00e9 de la dur\u00e9e de l&#39;hypoth\u00e8que ou dans la seconde). En ce qui concerne les hypoth\u00e8ques \u00e0 taux variable, les frais peuvent \u00eatre au maximum de 0,25 % si le remboursement intervient dans les trois premi\u00e8res ann\u00e9es du contrat hypoth\u00e9caire, et de 0,15 % de la troisi\u00e8me \u00e0 la cinqui\u00e8me ann\u00e9e. Dans le cas des pr\u00eats hypoth\u00e9caires \u00e0 taux fixe, la limite est de 2 % pendant les 10 premi\u00e8res ann\u00e9es du contrat et de 1,5 % par la suite.<\/li>\n<li> La p\u00e9riode de non-paiement est prolong\u00e9e, apr\u00e8s quoi la banque peut engager la proc\u00e9dure d&#39;embargo. Cette mesure vise \u00e0 prot\u00e9ger les titulaires de pr\u00eats hypoth\u00e9caires qui \u00e9prouvent des difficult\u00e9s financi\u00e8res passag\u00e8res. Selon la nouvelle loi, la banque peut activer la clause dite de remboursement anticip\u00e9 en cas de non-paiement si le pr\u00eat hypoth\u00e9caire a plus de 12 mois, ou si la dette est d&#39;au moins 3% du total du pr\u00eat.<\/li>\n<li> L&#39;interdiction de toute r\u00e9serve comme la sensationnelle &quot;cl\u00e1usula suelo&quot;. Cette clause du contrat d&#39;hypoth\u00e8que \u00e0 taux variable \u00e9tablissait sa valeur minimale, et le client \u00e9tait oblig\u00e9 de rembourser l&#39;hypoth\u00e8que conform\u00e9ment au taux sp\u00e9cifi\u00e9 m\u00eame apr\u00e8s que la valeur de l&#39;indice Euribor ait chut\u00e9 de mani\u00e8re significative, et avec elle les taux d&#39;int\u00e9r\u00eat qui y \u00e9taient li\u00e9s . Toutes les r\u00e9serves actuellement existantes qui entrent en conflit avec les conditions de transparence seront supprim\u00e9es.<\/li>\n<li> R\u00e9duction du co\u00fbt et simplification du processus de conversion d&#39;une hypoth\u00e8que \u00e0 taux variable en une hypoth\u00e8que \u00e0 taux fixe. En outre, la proc\u00e9dure de conversion en euros d&#39;un pr\u00eat accord\u00e9 en devise \u00e9trang\u00e8re sera simplifi\u00e9e.<\/li>\n<li> La nouvelle loi limite les frais de d\u00e9faut (p\u00e9nalit\u00e9), qui seront d\u00e9sormais calcul\u00e9s selon le sch\u00e9ma : le taux d&#39;int\u00e9r\u00eat pay\u00e9 par le client, major\u00e9 de 3 % pendant la p\u00e9riode pendant laquelle la dette reste impay\u00e9e. De plus, des int\u00e9r\u00eats ne peuvent \u00eatre imput\u00e9s que sur le montant restant d\u00fb.<\/li>\n<li> Il est interdit aux banques d&#39;obliger les clients \u00e0 souscrire d&#39;autres produits financiers, tels que l&#39;assurance habitation ou l&#39;assurance-vie, comme condition d&#39;octroi d&#39;un pr\u00eat hypoth\u00e9caire.<\/li>\n<li> R\u00e9partition claire et transparente des frais de traitement des hypoth\u00e8ques : le client ne paie que pour l&#39;\u00e9valuation du bien et pour lui fournir une copie (ou plusieurs copies) du contrat.<\/li>\n<li> Les banques sont tenues d&#39;\u00e9tudier attentivement la solvabilit\u00e9 du client, ainsi que de lui fournir des informations d\u00e9taill\u00e9es sur les d\u00e9tails de la transaction, pr\u00e9sent\u00e9es sous une forme claire et compr\u00e9hensible, ainsi que de r\u00e9soudre tous ses doutes pendant la dur\u00e9e du contrat hypoth\u00e9caire. . En particulier, la banque doit examiner les ant\u00e9c\u00e9dents de cr\u00e9dit d&#39;un emprunteur potentiel en demandant des informations au Centre d&#39;information sur les risques de la Banque d&#39;Espagne.<\/li>\n<\/ul>\n<p> La nouvelle loi hypoth\u00e9caire s&#39;applique \u00e0 tous les nouveaux cr\u00e9dits hypoth\u00e9caires \u00e9mis depuis son entr\u00e9e en vigueur aux particuliers et destin\u00e9s \u00e0 l&#39;achat de biens immobiliers r\u00e9sidentiels (pr\u00eats ou en cours de construction) et d&#39;immeubles d&#39;habitation.
