Il s&#39;agit notamment de ceux qui louent des logements pour les touristes. Arturo Jim\u00e9nez Contento, directeur de la recherche \u00e0 l&#39;Association espagnole des conseillers fiscaux (AEDAF), a d\u00e9crit neuf \u00e9l\u00e9ments cl\u00e9s qu&#39;un propri\u00e9taire de propri\u00e9t\u00e9 touristique espagnol doit garder \u00e0 l&#39;esprit lors du paiement de l&#39;imp\u00f4t sur le revenu.<\/p>\n<ul>\n<li> Tous les revenus provenant des locations touristiques sont soumis \u00e0 d\u00e9claration. L&#39;exception concerne les cas o\u00f9 le montant des revenus de la location d&#39;un logement ne d\u00e9passe pas 1 000 \u20ac par an.<\/li>\n<li> Le propri\u00e9taire de ce logement, le titulaire du droit de propri\u00e9t\u00e9 d&#39;utiliser ce bien et le droit de s&#39;approprier les revenus qu&#39;il en retire (usufruit) ou le locataire ou le sous-locataire qui a re\u00e7u l&#39;autorisation appropri\u00e9e du propri\u00e9taire doit d\u00e9clarer les revenus de la location de les h\u00e9bergements touristiques soumis \u00e0 l&#39;imp\u00f4t sur le revenu des personnes physiques.<\/li>\n<li> Lors de la campagne de d\u00e9claration de revenus 2018, certains contribuables peuvent \u00eatre confront\u00e9s \u00e0 une situation o\u00f9 les informations sur les revenus locatifs touristiques ne figurent pas dans le projet de d\u00e9claration. Cela ne signifie pas qu&#39;ils n&#39;ont pas besoin d&#39;\u00eatre d\u00e9clar\u00e9s. Si le propri\u00e9taire qui a per\u00e7u des revenus locatifs touristiques en 2018 ne trouve pas d&#39;informations \u00e0 leur sujet dans le projet de d\u00e9claration, il doit lui-m\u00eame transmettre ces donn\u00e9es.<\/li>\n<li> Les revenus de la location d&#39;h\u00e9bergements touristiques sont d\u00e9clar\u00e9s diff\u00e9remment selon les circonstances de la location. Ainsi, si la prestation de location ne comprend pas une prestation d&#39;entretien d&#39;accompagnement (nettoyage p\u00e9riodique, changement du linge de lit, de toilette, etc.), le b\u00e9n\u00e9fice est d\u00e9clar\u00e9 en revenus immobiliers s&#39;il est d\u00e9clar\u00e9 par le propri\u00e9taire ou l&#39;usufruitier (d\u00e9tenteur du droit d&#39;usufruit). Si la d\u00e9claration est faite par le locataire ou le sous-locataire, le b\u00e9n\u00e9fice est d\u00e9clar\u00e9 comme revenu mobilier. Si une prestation d&#39;entretien est comprise dans la prestation de location, le b\u00e9n\u00e9fice est d\u00e9clar\u00e9 comme revenu d&#39;activit\u00e9 \u00e9conomique par le propri\u00e9taire ou l&#39;usufruitier.<\/li>\n<li> Lors de la d\u00e9claration des revenus de la location d&#39;un h\u00e9bergement touristique, le contribuable doit \u00eatre conscient qu&#39;il a droit \u00e0 des d\u00e9ductions pour les d\u00e9penses suivantes : les int\u00e9r\u00eats pay\u00e9s sur le capital emprunt\u00e9 investi dans l&#39;acquisition ou le d\u00e9veloppement de l&#39;objet locatif ; les frais de r\u00e9paration et d&#39;entretien de ce logement ; les taxes et frais associ\u00e9s \u00e0 ce logement et pay\u00e9s par le propri\u00e9taire (par exemple, IBI, frais de ramassage des ordures, etc.); le montant de la dette si le d\u00e9biteur (locataire) est en situation de faillite, ou si plus de six mois se sont \u00e9coul\u00e9s depuis le remboursement pr\u00e9vu de la dette, et que la dette n&#39;a pas \u00e9t\u00e9 pay\u00e9e ; les sommes vers\u00e9es \u00e0 titre de r\u00e9mun\u00e9ration \u00e0 des tiers pour la prestation de services professionnels li\u00e9s \u00e0 l&#39;objet lou\u00e9 (administration, gardiennage, entretien, etc.). Cela comprend \u00e9galement les co\u00fbts li\u00e9s \u00e0 l&#39;utilisation des plateformes de location en ligne, les frais d&#39;assurance, le co\u00fbt du paiement des factures d&#39;\u00e9lectricit\u00e9, d&#39;eau et de gaz et les co\u00fbts d&#39;amortissement.<\/li>\n<li> Si le propri\u00e9taire de la location touristique ou le titulaire de l&#39;usufruit n&#39;a pas d\u00e9clar\u00e9 les revenus per\u00e7us de cette source, la situation doit \u00eatre r\u00e9gularis\u00e9e. Le minist\u00e8re des Finances pr\u00e9l\u00e8ve un imp\u00f4t sur le revenu m\u00eame sur les revenus qui n&#39;ont pas \u00e9t\u00e9 d\u00e9clar\u00e9s. Dans ce cas, des frais de p\u00e9nalit\u00e9 seront inclus dans le montant. De plus, des sanctions peuvent \u00eatre appliqu\u00e9es. Dans tous les cas, avant que le minist\u00e8re des Finances n&#39;intervienne, le contribuable peut d\u00e9poser une d\u00e9claration suppl\u00e9mentaire pour les p\u00e9riodes fiscales pr\u00e9c\u00e9dentes (cette ann\u00e9e, la derni\u00e8re p\u00e9riode de d\u00e9claration pour laquelle une d\u00e9claration suppl\u00e9mentaire peut \u00eatre d\u00e9pos\u00e9e est 2014). En cas de d\u00e9p\u00f4t d&#39;une d\u00e9claration compl\u00e9mentaire, le contribuable se voit imposer une p\u00e9nalit\u00e9, mais il \u00e9vite les sanctions.<\/li>\n<li> Les frais de remise en \u00e9tat d&#39;un bien locatif touristique et de son ameublement sont d\u00e9ductibles, mais selon un r\u00e9gime particulier. Le montant des charges est r\u00e9parti sur plusieurs p\u00e9riodes de reporting, c&#39;est-\u00e0-dire la d\u00e9duction ne peut pas \u00eatre appliqu\u00e9e \u00e0 une d\u00e9claration d&#39;un an. Ces frais sont inclus dans les dotations aux amortissements. Afin de d\u00e9duire le co\u00fbt de l&#39;ameublement d&#39;un bien locatif touristique, le contrat de location doit pr\u00e9ciser que le bien est enti\u00e8rement \u00e9quip\u00e9.<\/li>\n<li> Si le propri\u00e9taire de la location touristique est une personne physique qui ne r\u00e9side pas en Espagne, c&#39;est-\u00e0-dire qu&#39;il vit hors d&#39;Espagne plus de 183 jours par an, deux options s&#39;offrent \u00e0 vous. Si le propri\u00e9taire est r\u00e9sident d&#39;un autre pays de l&#39;UE ou de l&#39;Espace \u00e9conomique europ\u00e9en (EEE), l&#39;imposition des revenus immobiliers s&#39;effectue comme suit : les d\u00e9penses sont d\u00e9duites du montant total des fonds re\u00e7us de la location d&#39;un logement touristique, et le le montant restant (revenu net) est imposable \u00e0 un taux fixe de 19 %. Le montant des revenus per\u00e7us par un non-r\u00e9sident espagnol de la location d&#39;un logement en Espagne doit \u00eatre inclus dans le montant total des revenus d\u00e9clar\u00e9s par lui dans le pays dont il est r\u00e9sident, puis d\u00e9duit du montant des imp\u00f4ts \u00e0 payer en Espagne. Si le propri\u00e9taire est r\u00e9sident d&#39;un pays en dehors de l&#39;UE ou de l&#39;EEE, le montant total des revenus per\u00e7us de la location d&#39;un logement en Espagne pour les locations touristiques est d\u00e9duit des d\u00e9penses, et un taux de 24% est appliqu\u00e9 au montant restant (net revenu).<\/li>\n<li> Si le propri\u00e9taire de la propri\u00e9t\u00e9 touristique n&#39;est pas une personne physique, mais une personne morale, les revenus locatifs sont soumis \u00e0 l&#39;imp\u00f4t sur les soci\u00e9t\u00e9s et sont inclus dans la d\u00e9claration
