{"id":11525,"date":"2019-01-09T02:51:21","date_gmt":"2019-01-08T23:51:21","guid":{"rendered":"https:\/\/alegria-realestate.com\/?p=11525"},"modified":"2025-08-14T19:41:35","modified_gmt":"2025-08-14T16:41:35","slug":"long-term-rental-properties-in-spain-important-changes","status":"publish","type":"post","link":"https:\/\/alegria-realestate.com\/nl\/articles\/long-term-rental-properties-in-spain-important-changes","title":{"rendered":"Langetermijnverhuur van onroerend goed in Spanje: belangrijke veranderingen"},"content":{"rendered":"<p>Spanje wordt traditioneel beschouwd als een land van huiseigenaren: de meerderheid van de burgers (inclusief buitenlanders die naar dit land zijn verhuisd voor <a href=\"about\/news\/kak-uehat-v-ispaniju-na-pmzh.html\">permanente verblijfsvergunning<\/a> ) gaf er de voorkeur aan om in <a href=\"catalog\/sale\/\">hun eigen huis<\/a> te wonen in plaats van te huren. Maar alles verandert, en de afgelopen jaren hebben we een gestage toename gezien in de vraag naar langetermijnverhuur. Momenteel woont bijna 25% van de gezinnen in Spanje in <a href=\"catalog\/rent\/\">een huurwoning<\/a> . Dit komt door het gebrek aan beschikbare middelen om <a href=\"about\/faq\/\">een appartement of huis te kopen<\/a> , en de angst om zichzelf te belasten met een <a href=\"about\/news\/mortgages-in-spain-for-non-residents.html\">hypotheeklening<\/a> voor meerdere jaren, en de onwil om geografisch gebonden te zijn aan een bepaalde plaats. Medio december 2018 trad in Spanje een decreet in werking dat belangrijke wijzigingen in de langetermijnverhuur van residentieel onroerend goed in Spanje introduceerde. We moeten meteen opmerken dat bijna alle innovaties gericht zijn op de bescherming van de huurder, en de verhuurder &#8211; de eigenaar van het onroerend goed &#8211; wordt nu gedwongen om te voldoen aan nog strengere verplichtingen. De wet heeft geen terugwerkende kracht, d.w.z. alle langlopende huurovereenkomsten die v\u00f3\u00f3r de inwerkingtreding van het decreet zijn gesloten, blijven onderworpen aan de voorheen geldende regels. De versoepeling is alleen toegestaan voor woningen met een grote oppervlakte (meer dan 300 m\u00b2) en\/of een inkomen dat het vastgestelde minimumloon voor interprofessionele werknemers met 5,5 keer overschrijdt. Sinds 1 januari 2019 bedraagt het minimumloon in Spanje 900 euro per maand. <img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-11527\" src=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/02\/dolgosrochnaia-arenda-v-ispanii-img-2.jpg\" alt=\"\" width=\"887\" height=\"520\" srcset=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/02\/dolgosrochnaia-arenda-v-ispanii-img-2.jpg 887w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/02\/dolgosrochnaia-arenda-v-ispanii-img-2-300x176.jpg 300w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/02\/dolgosrochnaia-arenda-v-ispanii-img-2-768x450.jpg 768w\" sizes=\"auto, (max-width: 887px) 100vw, 887px\" \/><\/p>\n<h2> Duur van een langlopende huurovereenkomst voor onroerend goed in Spanje<\/h2>\n<p> De minimale looptijd van een huurovereenkomst voor onroerend goed op lange termijn in Spanje bedraagt momenteel 5 jaar als de huurder een natuurlijk persoon is, en 7 jaar als het <a href=\"about\/news\/how-to-open-a-business-in-spain-russian.html\">een rechtspersoon betreft<\/a> (voorheen was dit 3 jaar voor iedereen). Indien de partijen na afloop van de gestelde termijnen de contractuele relatie niet be\u00ebindigen, wordt de overeenkomst automatisch met nog eens 3 jaar verlengd (voorheen met 1 jaar). De verhuurder heeft slechts in \u00e9\u00e9n geval het recht om de overeenkomst vroegtijdig te be\u00ebindigen: als hij dringend woonruimte nodig heeft voor zijn gezin. Na ontvangst van de sleutels van de huurder is de verhuurder verplicht om binnen drie maanden de woning te betrekken, anders ontstaan er problemen: vanaf de terugkeer van de huurder en de berekening van de looptijd van de overeenkomst tot de betaling van een schadevergoeding. De huurder heeft zelf het recht om de overeenkomst na zes maanden te be\u00ebindigen zonder enige schadevergoeding aan de verhuurder te betalen.<\/p>\n<h2> Prijzen: Huur en waarborgsom<\/h2>\n<p> De prijsstelling vindt momenteel plaats op basis van volledige vrijheid. De hoogte van de indexering is vastgelegd in het contract en de partijen behouden zich ook het recht voor om de indexering volledig te weigeren. De Spaanse wetgevers zijn echter van plan om in 2019 de regulering van huurprijzen in grote Spaanse steden goed te keuren. Overigens, aangezien we het over de prijs hebben, willen we u er snel op wijzen dat er al een wetsontwerp ter voorkoming en bestrijding van belastingfraude is opgesteld en in afwachting is van goedkeuring. Volgens deze wet moet een huurder die bereid is een bedrag van meer dan 10.000 euro per maand voor huisvesting te betalen, de bron van de middelen bevestigen. De nieuwe wetgeving beperkt de hoogte van de borg tot het bedrag van \u00e9\u00e9n maandelijkse huur. En in de eerste vijf (zeven) jaar van de huurovereenkomst kan dit bedrag niet worden herzien. Een bankstorting of een bankstorting kan bijvoorbeeld als een dergelijke garantie dienen. Dat wil zeggen dat de &quot;veiligheidsbuffer&quot; van de verhuurder in totaal niet hoger mag zijn dan het bedrag dat overeenkomt met drie huurbetalingen. In geval van aanzienlijke schade aan de woning door de huurder, of in geval van gedwongen uitzetting van een oneerlijke huurder die in gebreke blijft, dekt het gespecificeerde bedrag slechts een klein deel van de schade van de verhuurder. Een dergelijke situatie dwingt de verhuurder om te zoeken naar alternatieve, wettelijk toegestane, verzekeringen. Bijvoorbeeld door van de potenti\u00eble huurder te eisen dat hij een derde garant of borgsteller aanstelt, die, indien nodig, subsidiair aansprakelijk
