De nieuwe organieke wet 1\/2025 verandert de procedure voor het reageren op gevallen van woninginbraak en ongeoorloofde bewoning, waardoor deze sneller, strenger en effectiever wordt. Beide misdrijven \u2013 woninginbraak en ongeoorloofde bewoning \u2013 worden nu behandeld in een versnelde strafrechtelijke procedure, waardoor er binnen 15 dagen na de eerste zitting een beslissing kan worden genomen. Voorheen konden dergelijke zaken maanden of zelfs jaren aanslepen, waardoor eigenaren kwetsbaar waren voor langdurige juridische procedures.<\/p>\n<h2> Wat is het verschil tussen invasie en kraken?<\/h2>\n<ul>\n<li> <strong>Een woningoverval (allanamiento de morada)<\/strong> is wanneer iemand illegaal de woning van een ander binnendringt. Dit wordt beschouwd als een ernstig misdrijf omdat het het recht op privacy schendt. Als de overtreding binnen 48 uur wordt ontdekt, kan de politie de overtreder zonder gerechtelijk bevel uitzetten.<\/li>\n<li> <strong>Kraken (usurpaci\u00f3n de vivienda)<\/strong> is het bewonen van een niet-residenti\u00eble woning of tweede woning, zoals een zomerhuis, leegstaand huis of appartement. Het is een minder ernstig misdrijf, maar kan nu ook versneld worden vervolgd.<\/li>\n<\/ul>\n<h2> Hoe werkt het systeem nu?<\/h2>\n<ol>\n<li> De eigenaar ontdekt de okupas en neemt contact op met de politie of de dienstdoende rechtbank.<\/li>\n<li> Er wordt een versnelde strafzaak gestart.<\/li>\n<li> De bewoners worden als gedaagden voor de rechter gedaagd, de eigenaar als slachtoffer.<\/li>\n<li> Indien de bewoners geen documenten kunnen overleggen waaruit hun verblijfsrecht blijkt (huurovereenkomst e.d.), worden zij als schuldig beschouwd.<\/li>\n<li> Na de uitspraak wordt besloten om zo snel mogelijk te ontruimen.<\/li>\n<\/ol>\n<p> <strong>Belangrijk:<\/strong> Nu kunnen de indringers zich niet langer enkel beroepen op de erbarmelijke situatie of het gebrek aan huisvesting als er geen wettelijke basis voor verblijf is. Dit is geen verweer meer.<\/p>\n<h2> Verantwoordelijkheid wordt strenger<\/h2>\n<ul>\n<li> Boetes voor kleine zaken.<\/li>\n<li> Gevangenisstraf &#8211; als de inbeslagname gepaard ging met geweld of bedreigingen.<\/li>\n<\/ul>\n<p> Dus als u een huiseigenaar bent in Spanje, bent u nu veel beter beschermd dan voorheen. Dit is een teken dat de staat echt een maatschappelijk probleem begint op te lossen dat velen zorgen baart.
