{"id":817788,"date":"2025-07-14T11:24:01","date_gmt":"2025-07-14T08:24:01","guid":{"rendered":"https:\/\/alegria-realestate.com\/?p=817788"},"modified":"2025-08-14T22:37:58","modified_gmt":"2025-08-14T19:37:58","slug":"vat-on-tourist-rentals-in-2025","status":"publish","type":"post","link":"https:\/\/alegria-realestate.com\/nl\/articles\/vat-on-tourist-rentals-in-2025","title":{"rendered":"BTW op toeristische verhuur in 2025"},"content":{"rendered":"<p>Nu het hoogseizoen nadert en de populariteit van vakantiewoningen toeneemt, vragen veel eigenaren zich af of ze btw moeten rekenen over hun vakantiewoningen. Idealista heeft een duidelijke uitleg gepubliceerd over wanneer deze belasting moet worden geheven, welke diensten relevant zijn, welke verplichtingen een verhuurder van vakantiewoningen heeft en hoe hij zijn inkomsten correct kan aangeven. De btw-wet ( <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1992-28740\">Ley de IVA<\/a> ) is gebaseerd op het principe dat deze belasting op vakantiewoningen alleen van toepassing is als er diensten worden aangeboden die vergelijkbaar zijn met die van een hotel. In de meeste gevallen beperken de diensten zich echter tot de sleuteloverdracht en de schoonmaak na elk vertrek (niet dagelijks), wat gronden geeft om ze gelijk te stellen aan een vakantiewoningen en daarom vrij te stellen van btw (artikel 20). Wanneer het echter gaat om dagelijkse schoonmaak, ontbijt, enz. verandert de situatie en wordt ervan uitgegaan dat er btw moet worden geheven. Vanaf 2025 zal de Spaanse belastingdienst de verblijfsduur niet langer als bepalende factor beschouwen bij het aangeven van vakantiewoningen. Het Europese pakket &quot;btw in het digitale tijdperk&quot; voorziet er echter in dat vanaf 1 juli 2028 alle verhuur tot 30 nachten als hotelaccommodatie wordt behandeld. Uiteindelijk zullen alle accommodaties voor minder dan 30 aaneengesloten dagen \u2013 oftewel kortlopende verhuur \u2013 deze belasting moeten heffen, ongeacht de geleverde diensten. Het doel is om een einde te maken aan de verschillen in behandeling tussen EU-lidstaten en concurrentieverstoringen in de toeristische accommodatiesector te voorkomen, wat een aantal verplichtingen met zich meebrengt:<\/p>\n<ul>\n<li> periodiek BTW aangeven;<\/li>\n<li> facturen voor deze belasting uitreiken en een boekhouding bijhouden;<\/li>\n<li> Bewaar alle documentatie minimaal vier jaar.<\/li>\n<\/ul>\n<p> Hoewel het btw-tarief nog niet is vastgesteld, wijst alles erop dat het 10% zal bedragen, net als bij andere toeristische diensten. Het niet naleven van dit criterium kan leiden tot boetes van meer dan 50% van het onbetaalde bedrag. De lijst met diensten waarvoor btw in rekening mag worden gebracht, is nog niet definitief. Deze omvatten, maar zijn niet beperkt tot:<\/p>\n<ul>\n<li> permanente registratie en onderhoud;<\/li>\n<li> periodieke schoonmaak van de priv\u00e9- en gemeenschappelijke ruimtes tijdens het verblijf van de gast in het pand;<\/li>\n<li> wisseling van handdoeken en beddengoed \u2013 minimaal \u00e9\u00e9n keer tijdens uw verblijf;<\/li>\n<li> het verstrekken van lichte maaltijden (ontbijt);<\/li>\n<li> de minibar bijvullen;<\/li>\n<li> bagageopslag;<\/li>\n<li> het wassen van persoonlijke spullen.<\/li>\n<\/ul>\n<p> Als twee of meer van deze elementen worden gecombineerd, beschouwt de Belastingdienst <a href=\"https:\/\/alegria-realestate.com\/ru\/service\/rent-apartment-in-spain\">het toeristische appartement<\/a> als vergelijkbaar met een boetiekhotel en past daarom een verlaagd btw-tarief van 10% toe. Het verhuren van toeristische accommodatie voor twee of meer nachten zonder aanvullende diensten \u2013 tussentijdse schoonmaak en verschoning van bedlinnen \u2013 is vrijgesteld van btw. Het nultarief betekent echter niet dat er geen andere belastingen van toepassing zijn. Inkomsten uit onroerend goed zijn onderworpen aan aangifte inkomstenbelasting, zelfs als er geen btw wordt afgetrokken voor reparaties of roerende goederen. Het is raadzaam om contracten en bewijsstukken te bewaren, aangezien de belastingdienst deze informatie kan opvragen in geval van een controle. Voor aanvullende diensten die geen verband houden met accommodatie of logies, geldt een algemeen tarief van 21%.
