{"id":89569,"date":"2019-07-12T13:02:52","date_gmt":"2019-07-12T10:02:52","guid":{"rendered":"https:\/\/alegria-realestate.com\/?p=89569"},"modified":"2025-08-14T19:50:29","modified_gmt":"2025-08-14T16:50:29","slug":"ocupas-in-spain","status":"publish","type":"post","link":"https:\/\/alegria-realestate.com\/nl\/articles\/ocupas-in-spain","title":{"rendered":"Okupas in Spanje: hoe legaal te vechten"},"content":{"rendered":"<p><\/p>\n<h2>Okupas in Spanje: hoe krijg je op legale wijze weer eigenaar van een woning die illegaal door derden wordt bewoond?<\/h2>\n<p> Het fenomeen van illegale bewoning van woningen \u2013 ocupas \u2013 is de afgelopen jaren in Spanje berucht geworden als gevolg van de massa vonnissen tegen banken die deelnemen aan veilingen. Banken hebben reserves aan leegstaande woningen opgebouwd, die moeilijk te beheren en zeer moeilijk te controleren zijn vanwege hun grote aantal. Hierdoor worden bankwoningen vaak het voorwerp van illegale bewoning. Maar het zijn niet alleen appartementen die eigendom zijn van banken of beleggingsfondsen die het voorwerp zijn van illegale bewoning. In veel gevallen zijn de slachtoffers van ocupas in Spanje particuliere huiseigenaren, vaak buitenlanders die een tweede <a href=\"https:\/\/alegria-realestate.com\/ru\/sale\">huis in Spanje<\/a> hebben gekocht en hier niet permanent kunnen wonen. Het probleem is dat u de illegale bewoner niet zelf kunt uitzetten. Als u erachter komt dat uw woning door vreemden is bewoond zonder toestemming of huurovereenkomst, is uw enige optie om een juridische procedure te starten en te wachten tot de rechtbank in uw voordeel beslist om de bewoners uit uw woning te zetten. <img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-89571\" src=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/07\/ocupas-in-spain1.jpg\" alt=\"Okupas in Spanje\" width=\"980\" height=\"552\" srcset=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/07\/ocupas-in-spain1.jpg 980w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/07\/ocupas-in-spain1-300x169.jpg 300w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2019\/07\/ocupas-in-spain1-768x433.jpg 768w\" sizes=\"auto, (max-width: 980px) 100vw, 980px\" \/> De eerste logische reactie van de eigenaar die een &quot;ocupa&quot; in zijn huis aantreft, is om naar de politie te gaan en aangifte te doen van illegale bewoning. Maar helaas is een strafrechtelijke procedure niet altijd de snelste manier om het bezit van de woning terug te krijgen. Tot voor kort was dit de enige uitweg, maar in 2018 werd een andere, snellere optie ge\u00efntroduceerd: de civiele procedure van &quot;expres&quot; uitzetting, ingevoerd door Wet 5\/2018 van 11 juni, die de illegale bewoning van woningen reguleert. Deze gerechtelijke procedure geeft de persoon die de woning heeft bewoond slechts 5 dagen vanaf de datum van kennisgeving van de ontruimingsvordering om de rechtbank een contract te overleggen waaruit blijkt dat hij de woning legaal mag gebruiken. Uiteraard hoeft hij niets te overleggen als het een &quot;ocupa&quot; betreft. In dit geval, en ook als het overgelegde document de rechter niet overtuigt, wordt de bewoning als illegaal erkend en wordt besloten de persoon die de woning bewoont onmiddellijk uit te zetten. De beschreven procedure verloopt veel sneller dan een normale uitzetting wegens wanbetaling of be\u00ebindiging van de huurovereenkomst. Het doel van de nieuwe wet is een procedurele oplossing te bieden die ervoor zorgt dat de illegale bewoning van de woning zo kort mogelijk duurt. Het is daarom belangrijk om te beoordelen of het zinvol is om de civiele of strafrechtelijke procedure te volgen voordat u aangifte doet bij de politie (de strafrechtelijke procedure). Zodra de aangifte is ingediend, wordt deze namelijk doorgestuurd naar de rechtbank (de strafrechtelijke rechtbank).
