{"id":443955,"date":"2021-09-24T15:22:03","date_gmt":"2021-09-24T12:22:03","guid":{"rendered":"https:\/\/alegria-realestate.com\/?p=443955"},"modified":"2025-12-05T21:05:44","modified_gmt":"2025-12-05T18:05:44","slug":"reverse-mortgage-in-spain","status":"publish","type":"post","link":"https:\/\/alegria-realestate.com\/sv\/articles\/property-in-spain\/reverse-mortgage-in-spain","title":{"rendered":"Pr\u00eat hypoth\u00e9caire invers\u00e9 en Espagne : comment \u00e7a marche ?"},"content":{"rendered":"<p>Anv\u00e4ndningen av <a href=\"https:\/\/alegria-realestate.com\/sv\/service\/mortgage-in-spain\">bol\u00e5neprodukter i Spanien<\/a> \u00e4r en vanlig praxis vid bostadsk\u00f6p, b\u00e5de bland lokalbefolkningen och bland utl\u00e4nningar.<\/p>\n<p>Den f\u00f6rsta bol\u00e5neboomen i landet intr\u00e4ffade p\u00e5 1970-talet, n\u00e4r man b\u00f6rjade bygga nya bostadshus i stor skala samt fastigheter kopplade till utvecklingen av turismsektorn. Under denna period b\u00f6rjade inv\u00e5nare fr\u00e5n landsbygdsregioner i stor omfattning flytta till st\u00f6rre st\u00e4der i jakt p\u00e5 h\u00f6gre inkomster och ett b\u00e4ttre liv. S\u00e4rskilt starkt m\u00e4rktes befolkningstillv\u00e4xten i st\u00e4der som Madrid, Barcelona och Bilbao.<\/p>\n<p>Bland de nya stadsborna och investerarna i <a href=\"https:\/\/alegria-realestate.com\/sv\/service\/rent-apartment-in-spain\">turistfastigheter<\/a> uppstod naturligt nog en h\u00f6g efterfr\u00e5gan p\u00e5 bostadsk\u00f6p \u2013 och d\u00e4rmed p\u00e5 bol\u00e5n. Inledningsvis erbj\u00f6d byggbolaget och\/eller promotorn bost\u00e4der till f\u00f6rs\u00e4ljning, och alla kostnader kopplade till k\u00f6pet l\u00e5g p\u00e5 k\u00f6paren.<\/p>\n<p>I avtalen, eller <em>letras para los pr\u00e9stamos hipotecarios<\/em> \u2013 brev om bol\u00e5n \u2013 angavs vanligtvis r\u00e4ntesats, l\u00e5nets l\u00f6ptid och storleken p\u00e5 m\u00e5nadsbetalningarna, och i registret inf\u00f6rdes en <em>condici\u00f3n resolutoria<\/em> \u2013 ett villkor som fastst\u00e4llde n\u00e4r k\u00f6paren blev fullv\u00e4rdig \u00e4gare till bostaden. Vid genomf\u00f6randet av aff\u00e4ren b\u00f6rjade man uppr\u00e4tta en notariehandling \u2013 <em>escritura notarial<\/em>.<\/p>\n<p>Under 1990-talet blev bol\u00e5n oerh\u00f6rt popul\u00e4ra, och bankerna t\u00e4vlade med varandra om att locka nya kunder med l\u00e5ga r\u00e4ntor och andra f\u00f6rm\u00e5nliga villkor.<\/p>\n<p>Den globala finanskrisen 2006\u20132014 ledde till en minskad efterfr\u00e5gan p\u00e5 nya bol\u00e5n. Senare b\u00f6rjade dock antalet undertecknade bol\u00e5neavtal \u00e5ter \u00f6ka, och \u00e5r 2017 \u00f6versteg antalet 300 000. Under 2020 registrerades cirka 334 000 bol\u00e5neavtal i landet, avsedda f\u00f6r bostadsk\u00f6p.<\/p>\n<p>I dag p\u00e5verkas bol\u00e5nemarknaden av sina egna s\u00e4rskilda faktorer. Spanien genomg\u00e5r n\u00e4mligen den allvarligaste demografiska krisen sedan inb\u00f6rdeskriget \u2013 detta framg\u00e5r av en ny rapport fr\u00e5n den nationella statistikmyndigheten.<\/p>\n<p>F\u00f6rra \u00e5ret noterades till exempel det h\u00f6gsta antalet d\u00f6dsfall och den l\u00e4gsta f\u00f6delsetalen sedan 1941. F\u00f6delsetalen sj\u00f6nk med n\u00e4stan 6 %, vilket forts\u00e4tter den ned\u00e5tg\u00e5ende trend som p\u00e5g\u00e5tt det senaste decenniet. Ser man p\u00e5 siffrorna fr\u00e5n 2010 och fram\u00e5t blir bilden \u00e4nnu m\u00f6rkare: f\u00f6delsetalen har minskat med 30 %.<\/p>\n<p><strong>Hur h\u00e4nger allt detta ihop med bol\u00e5n, undrar du kanske?<\/strong><\/p>\n<p>Sambandet \u00e4r tydligt: p\u00e5 grund av den demografiska krisen b\u00e4r Spaniens budget en betydande pensionsb\u00f6rda. D\u00e4rf\u00f6r inf\u00f6rdes 2009 ett s\u00e4rskilt program i landet, kallat <em>hipoteca inversa<\/em> \u2013 omv\u00e4nt bol\u00e5n. Som \u00e4gare kan personen v\u00e4nda sig till ett finansiellt institut f\u00f6r att f\u00e5 ett l\u00e5n mot bostaden som pant.<\/p>\n<p>Banken beviljar d\u00e5 ett l\u00e5n p\u00e5 cirka 50\u201360 % av bostadens v\u00e4rde, och den pantsatta bostaden fungerar som garanti f\u00f6r \u00e5terbetalningen.<\/p>\n<p>Efter den tidsperiod som anges i avtalet \u00e4r l\u00e5ntagaren skyldig att \u00e5terbetala hela l\u00e5net, eller \u2013 om inkomster saknas \u2013 s\u00e4lja bostaden f\u00f6r att betala skulden.<\/p>\n<p>Vid \u00e4garens d\u00f6d har de anh\u00f6riga r\u00e4tt att \u00e4rva bostaden, men samtidigt \u00f6vertar de \u00e4ven skyldigheten att betala tillbaka l\u00e5net.<\/p>\n<h3>Omv\u00e4nt bol\u00e5n med uppskjuten livr\u00e4nta \u2013 <em>Hipoteca inversa con renta vitalicia diferida<\/em><\/h3>\n<p>I praktiken kombinerar denna modell tv\u00e5 produkter: ett bankl\u00e5n med bostaden som s\u00e4kerhet och en livsl\u00e5ng pension. F\u00f6rst beviljar banken ett vanligt l\u00e5n som kunden \u00e5tar sig att \u00e5terbetala. Vid \u00e4garens d\u00f6d kan bostaden \u00e4rvas av hans eller hennes efterkommande, tillsammans med de finansiella f\u00f6rpliktelserna.<\/p>\n<p>Om kunden hinner \u00e5terbetala l\u00e5net under sin livstid blir banken i sin tur skyldig att betala ut en m\u00e5natlig livr\u00e4nta: f\u00f6r en bostad v\u00e4rd 300 000 euro kan \u00e4garen f\u00e5 omkring 200 euro i m\u00e5naden. \u00c4ven om beloppet inte verkar h\u00f6gt kan det p\u00e5 l\u00e5ng sikt vara ett trevligt tillskott till pensionen.<\/p>\n<p>En f\u00f6rdel med omv\u00e4nt bol\u00e5n med uppskjuten livr\u00e4nta \u00e4r att l\u00e5ntagaren har r\u00e4tt att bo i bostaden under hela sin livstid. Om kunden d\u00e4remot hinner l\u00f6sa bol\u00e5net helt \u00e4r banken skyldig att betala ut en m\u00e5natlig ers\u00e4ttning (livr\u00e4nta) till honom eller henne fram till livets slut.<\/p>\n<p>Om bostads\u00e4garen lever l\u00e4nge kan han eller hon under hela livet f\u00e5 den \u00f6verenskomna livr\u00e4ntan och samtidigt bo kvar i bostaden, med st\u00f6d av en nyttjander\u00e4tt (usufrukt) som ger r\u00e4tt att anv\u00e4nda n\u00e5gon annans (i detta fall bankens) egendom och tillgodog\u00f6ra sig avkastningen, under f\u00f6ruts\u00e4ttning att egendomens skick, v\u00e4rde och anv\u00e4ndningsomr\u00e5de bevaras.<\/p>\n<p>Om kunden d\u00f6r i f\u00f6rtid, utan att ha hunnit utnyttja en betydande del av livr\u00e4ntan, f\u00f6rlorar arvingarna \u00e4nd\u00e5 r\u00e4tten till bostaden och m\u00e5ste \u00e5terbetala hela det belopp som l\u00e5neinstitutet st\u00e4llt till f\u00f6rfogande f\u00f6r livr\u00e4ntan.<\/p>\n<h3>F\u00f6rs\u00e4ljning med r\u00e4tt att bo kvar \u2013 <em>Vivienda pensi\u00f3n<\/em><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-443958 size-full\" src=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/hipoteca-inversa.jpeg\" alt=\"\u041e\u0431\u0440\u0430\u0442\u043d\u0430\u044f \u0438\u043f\u043e\u0442\u0435\u043a\u0430 \u0432 \u0418\u0441\u043f\u0430\u043d\u0438\u0438: \u043a\u0430\u043a \u044d\u0442\u043e \u0440\u0430\u0431\u043e\u0442\u0430\u0435\u0442?\" width=\"900\" height=\"300\" srcset=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/hipoteca-inversa.jpeg 900w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/hipoteca-inversa-300x100.jpeg 300w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/hipoteca-inversa-768x256.jpeg 768w\" sizes=\"auto, (max-width: 900px) 100vw, 900px\" \/><\/p>\n<p>Den spanska staten har ocks\u00e5 utvecklat ett intressant alternativ d\u00e4r bostads\u00e4garen s\u00e4ljer sin bostad men beh\u00e5ller r\u00e4tten att forts\u00e4tta bo i den (usufrukt). Det finns dessutom m\u00f6jlighet att teckna ett hyresavtal. Om kunden utnyttjar sin nyttjander\u00e4tt f\u00e5r han eller hon k\u00f6peskillingen men kan \u00e4nd\u00e5 forts\u00e4tta bo i bostaden resten av livet.<\/p>\n<p>Efter \u00e4garens d\u00f6d kan den nye \u00e4garen n\u00e4stan omedelbart utnyttja sin fulla f\u00f6rfogander\u00e4tt \u00f6ver bostaden. P\u00e5 l\u00e5ng sikt kan en s\u00e5dan aff\u00e4r vara mycket f\u00f6rdelaktig, eftersom priset f\u00f6r bostaden normalt \u00e4r betydligt l\u00e4gre \u00e4n vid en vanlig f\u00f6rs\u00e4ljning. Samtidigt \u00e4r det om\u00f6jligt att i f\u00f6rv\u00e4g veta hur l\u00e4nge den nye \u00e4garen m\u00e5ste v\u00e4nta innan han eller hon faktiskt kan flytta in.<\/p>\n<p>Det pris som s\u00e4tts p\u00e5 bostaden vid denna typ av transaktion varierar i regel kraftigt beroende p\u00e5 s\u00e4ljarens \u00e5lder.<\/p>\n<p>Om det r\u00f6r sig om en mycket \u00e4ldre person, som dessutom bor ensam och har h\u00e4lsoproblem, kan priset ligga n\u00e4ra marknadsv\u00e4rdet, men \u00e4nd\u00e5 med en m\u00e4rkbar rabatt.<\/p>\n<p>Om s\u00e4ljaren d\u00e4remot nyss g\u00e5tt i pension kan en s\u00e5dan aff\u00e4r, med tanke p\u00e5 den gynnsamma livsl\u00e4ngden i Spanien \u2013 i genomsnitt 82,3 \u00e5r (2020) \u2013 vara mycket f\u00f6rdelaktig f\u00f6r honom eller henne. Dessutom \u00e4r f\u00f6rs\u00e4ljning av den huvudsakliga bostaden, dvs. den permanenta bostaden, f\u00f6r personer \u00f6ver 65 \u00e5r i regel befriad fr\u00e5n kapitalvinstskatt (skillnaden mellan k\u00f6p- och f\u00f6rs\u00e4ljningspris).<\/p>\n<p>Finns det n\u00e5gon vinst \u00e4ven f\u00f6r k\u00f6paren? Absolut. I Barcelona kan man till exempel, enligt denna modell, k\u00f6pa en bostad v\u00e4rd 250 000\u2013300 000 euro f\u00f6r 60 000\u201370 000 euro. Det \u00e4r sant att du troligen inte kan flytta in i ditt nya hem s\u00e4rskilt snart, men som en l\u00e5ngsiktig investering f\u00f6r barn eller barnbarn kan det vara ett utm\u00e4rkt alternativ.<\/p>\n<p>F\u00f6r s\u00e4ljarens arvingar ser situationen inte lika ljus ut: de kan varken \u00e4rva bostaden eller l\u00f6sa in den f\u00f6r det pris som s\u00e4ljaren har fastst\u00e4llt \u2013 de f\u00f6rlorar helt enkelt all r\u00e4tt till denna bostad.<\/p>\n<h3>F\u00f6rs\u00e4ljning utan r\u00e4tt att bo kvar \u2013 <em>Venta de la vivienda<\/em><\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-443961 size-full\" src=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/vender-casa.jpeg\" alt=\"\u041e\u0431\u0440\u0430\u0442\u043d\u0430\u044f \u0438\u043f\u043e\u0442\u0435\u043a\u0430 \u0432 \u0418\u0441\u043f\u0430\u043d\u0438\u0438: \u043a\u0430\u043a \u044d\u0442\u043e \u0440\u0430\u0431\u043e\u0442\u0430\u0435\u0442?\" width=\"980\" height=\"550\" srcset=\"https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/vender-casa.jpeg 980w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/vender-casa-300x168.jpeg 300w, https:\/\/alegria-realestate.com\/wp-content\/uploads\/2021\/09\/vender-casa-768x431.jpeg 768w\" sizes=\"auto, (max-width: 980px) 100vw, 980px\" \/><\/p>\n<p>I detta fall s\u00e4ljer bostads\u00e4garen sin bostad och m\u00e5ste sj\u00e4lv permanent flytta till en annan plats. Det kan handla om att bo l\u00e5ngvarigt hos n\u00e4ra sl\u00e4ktingar, i ett eget fritidshus eller p\u00e5 ett \u00e4ldreboende.<\/p>\n<p>Hela f\u00f6rs\u00e4ljningsint\u00e4kten placeras p\u00e5 ett bankkonto. Finansinstitutet \u00e5terinvesterar och f\u00f6rvaltar dessa pengar och betalar ut ett fast m\u00e5nadsbelopp till pension\u00e4ren. Efter bostads\u00e4garens d\u00f6d kan arvingarna f\u00e5 ut de \u00e5terst\u00e5ende medlen.<\/p>\n<p>Detta \u00e4r allts\u00e5 ett ytterligare s\u00e4tt att p\u00e5 ett klokt s\u00e4tt anv\u00e4nda kapitalet som frig\u00f6rs ur bostaden och s\u00e4kerst\u00e4lla en livsl\u00e5ng extra inkomst. N\u00e4r du s\u00e4ljer bostaden b\u00f6r du dock noggrant t\u00e4nka igenom var din permanenta bostad ska finnas i forts\u00e4ttningen.<\/p>\n<p>K\u00f6paren betalar bostadens fulla marknadsv\u00e4rde, vilket garanterar s\u00e4ljaren en god och stabil livr\u00e4nta.<\/p>\n<p>En s\u00e5dan f\u00f6rs\u00e4ljning och investering av f\u00f6rs\u00e4ljningsint\u00e4kten i en livr\u00e4nta omfattas dessutom ofta av f\u00f6rdelaktiga skatteregler.<\/p>\n<p>Den enda tydliga nackdelen \u00e4r kanske att den tidigare \u00e4garen efter aff\u00e4ren inte l\u00e4ngre kan bo i bostaden eller testamentera den till sina arvingar. Men i praktiken g\u00e4ller samma sak \u00e4ven vid en vanlig f\u00f6rs\u00e4ljning utan s\u00e4rskilda bol\u00e5nearrangemang.<\/p>\n<p>K\u00e4nde du till m\u00f6jligheten till omv\u00e4nt bol\u00e5n i Spanien \u2013 och skulle du vilja utnyttja den?
