The digital nomad visa in Spain is a new legalization pathway aimed at remote employees and freelancers who wish to live in the Kingdom while working remotely. The conditions for obtaining the Spanish digital nomad visa are regulated by the so-called “Startup Law” (Ley 28/2022, de 21 de diciembre, de fomento del ecosistema de las empresas emergentes), which entered into force on 23 December 2022.

Digital Nomad Visa in Spain: what you need to know

Under Spanish law, digital nomads (in the original: “teletrabajadores de carácter internacional”) are third-country nationals (non-EU) who work remotely for companies located outside Spain. The worker must prove their education, qualifications and professional experience.

To obtain the Spanish digital nomad visa you must meet several requirements, including:

• An employee (employment relationship) must work remotely for a company located outside Spain.
• Self-employed workers (freelancers) may work for a company located in Spain provided that this income does not exceed 20% of their total earnings.
• You must prove your level of education, qualifications and professional experience (minimum 3 years).
• You must prove the feasibility of remote work.
• Employment with the foreign company must have lasted at least 3 months.
• No criminal record in the last 2 years.

The digital nomad visa is valid for 1 year, after which you can obtain a 3-year residence permit. After this period, the residence permit is extended for a further 2 years.

Service cost for obtaining the Digital Nomad Visa in Spain
